The Uniform Rules Committee has made the following rule of court under the Civil Procedure

Explanatory note

The object of this Rule is to amend the Uniform Civil Procedure Rules 2005 to omit outdated references to the use of DX addresses for registries.

Uniform Civil Procedure (Amendment No 78) Rule 2016

1      Name of Rule

This Rule is the Uniform Civil Procedure (Amendment No 78) Rule 2016.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

3      Amendment of Uniform Civil Procedure Rules 2005

(1) Rule 4.10 Filing generally

Omit “address, or” from rule 4.10 (1) (b). Insert instead “address.”

(2) Rule 4.10 (1) (c)
Omit the paragraph.
(3) Rule 4.12 Lodgment of additional copies of originating process for service
Omit “or by use of an authorised DX system” from rule 4.12 (2) (b).
(4) Rule 10.8 Service of defence by court
Omit “in person, by post or by use of an authorised DX system,” from rule 10.8 (2).
Insert instead “in person or by post,”.
