The Uniform Rules Committee has made the following rule of court under the Civil Procedure

Explanatory note

The object of this Rule is to remove appeals under section 56A of the Land and Environment Court Act 1979 from those proceedings in the Land and Environment Court that are excluded from the operation of certain rules, in particular, rules relating to entitlement to costs.

1      Name of Rule

This Rule is the Uniform Civil Procedure (Amendment No 74) Rule 2015.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

3 Amendment of Uniform Civil Procedure Rules 2005

(1) Schedule 1 Application of rules

Insert “, other than proceedings under section 56A of the Land and Environment Court Act 1979” after “jurisdiction” in Column 2 of the matter relating to the Land and Environment Court.
