UNHEALTHY BUILDING LAND ACT 1990—REGULATION

(Unhealthy Building Land Regulation 1991)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Unhealthy Building Land Act 1990, has been

pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Unhealthy Building Land

Regulation 1991.

Commencement

2. This Regulation commences on 1 July 1991.

Definition

3. In this Regulation:

“the Act” means the Unhealthy Building Land Act 1990.

Certificate relating to declaration of land as unhealthy building land

4. For the purposes of section 8 (2) of the Act:

(a)

the form in which an application is to be made is the form set out in Schedule 1; and

(b) the prescribed fee is $10.00.

SCHEDULE 1—PROPERTY INFORMATION INQUIRY FORM

EXPLANATORY NOTE

Presently the Public Health Act 1902 provides for the declaration by the Minister of certain land as unhealthy building land and for the grant of certificates to the effect that specified land is not subject to a declaration as unhealthy building land. The Public Health Act 1902 is to be repealed by the Public Health Act 1991, which does not provide for the declaration of land as unhealthy building land.

The Unhealthy Building Land Act 1990 will provide for the declaration of unhealthy building land and the grant of certificates in relation to such declarations in substantially the same way as the Public Health Act 1902 did before its repeal. The object of this Regulation is to prescribe:

(a)

the form of application for a certificate as to whether or not land is the subject of a declaration as unhealthy building land; and

(b) the fee to accompany such an application.

The form and fee prescribed by this Regulation are identical to that prescribed under the Public Health Act 1902 (by Regulation 103A of the Public Health Regulations).

This Regulation prescribes matters of a machinery nature.
