Act No. 113, 1978.

An Act to amend the Unauthorised Documents Act, 1922, in relation to offences connected with the sending or delivering of false process documents and to increase the maximum penalties for certain offences under that Act. [Assented to, 20th December, 1978.1

Unauthorised Documents {Amendment).

BE it enacted by the Queen’s Most Excellent Majesty, by and with

the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

Short title.

1 .

This Act may be cited as the “Unauthorised Documents

(Amendment) Act, 1978”.

Amendment

2 . The Unauthorised Documents Act, 1922, is amended-

Sec. 3.

(a) by omitting from section 3 the words “forty dollars”

( 1 a ) For the purposes of subsection ( 1 ) , in determining whether a paper or writing is reason­ ably capable of conveying the impression that the paper or writing is an original or a copy of a document published or issued out of or by or under the authority or w'ith the sanction of any tribunal any statement in the paper or writing that or to the effect that—

(a)

it is not such a document or a copy of such a document; or

(b)

it is not intended to convey the impres­ sion that it is such a document or a copy of such a document,

shall be disregarded unless the statement is printed in a conspicuous position on the paper or writing and in a type that is more conspicuous than any other type used in the paper or writing.

(Ill) by omitting from section 4 (2) (b) the words “one

hundred dollars” and by inserting instead the matter

“ $ 1,000” .
