No 67)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Tweed Local Environmental Plan 2000 (Amendment

No 67).

2      Aims of plan

This plan aims to impose a condition on the erection of buildings on the land to which this plan applies so as:

(a)

to restrict single dwelling-houses, integrated housing and multi-dwelling housing (but only if there are no more than 2 dwellings on any single allotment of land) to a maximum height limit of 2 storeys, and

(b)

to restrict any other kind of building to a maximum height limit of 3 storeys.

3      Land to which plan applies

This plan applies to Lots 194, 301 and 312, DP 755701, Coast Road, South Kingscliff, as shown edged heavy black on the map marked “Tweed Local Environmental Plan 2000 (Amendment No 67)” deposited in the office of the Tweed Shire Council.

4 Amendment of Tweed Local Environmental Plan 2000

Tweed Local Environmental Plan 2000 is amended as set out in

Schedule 1.

Height restrictions—Coast Road, South Kingscliff

(1)

This clause applies to Lots 194, 301 and 312, DP 755701, Coast Road, South Kingscliff, as shown edged heavy black on the map marked “Tweed Local Environmental Plan 2000 (Amendment No 67)”.

(2)

Despite any other provision of this plan, in particular clause 16, consent must not be granted to the erection of a building on the land to which this clause applies if the building exceeds the following maximum height limit for the following kind of buildings:

(a)

2 storeys—single dwelling houses, integrated housing or multi-dwelling housing (but only if there are no more than 2 dwellings on any single allotment of land),

(b)

3 storeys—any kind of building not referred to in paragraph (a).
