536 @uccttslmth ANNO DECI.MO ELIZABETHAE SECUNDAE REGINAE. No. 5. An Act to Provide for the Grant in Fee-Simple to the Tully Sugar Milling Co-operative Association Limited of Certain Lands. [ASSENTED TO 24TH MARCH, 1961.] Preamble. WHEREAS, pursuant to "The Sugar Works Act of 1922," a sugar works area named the Tully Sugar Works Area was created and the Corporation of the 'l'reasurer created by " The Sugar Works Guarantee Acts Amendment Act of 1908 " (herein called the "Corporation") constructed sugar works known then as the Tully Sugar Works and now called the Tully Sugar Mill (herein called "the Tully Sugar Mill"),
1961. Tully Sugar M-ill (Lancl1; Grant) Act. and certain lands were taken under the provisions in force at the time of the taking thereof of " The Public Works Land Resumption Acts, 1906 to 1955," and vested in the Corporation for an estate in fee-simple : AND WHEREAS the lands so taken and vested included the land situated in the County of Cardwell, Parish of Rockingham, Town of Tully, described as sections, 11 and 12 : AND WHEREAS, pursuant to " The Tully Sugar Works Acts, 1930 to J.937," the management and control of the Tully Sugar Mill, being the sugar works defined by that Act, was transferred to and vested in the Tully Sugar Milling Co-operative Association Limited, a, co-operative association formed and registered under the provisions in force at the time of its formation and registration of " The Primary Producers' Co-operat£ve Associations Acts, 1923 to 1934," (herein called the "Association"), and the liability of the Corporation to the Treasurer in respect of such sugar works was taken over by the Association: AND WHEREAS " The Tully Sugar Works Acts, 1930 to 1937," provided that when the whole of the liability to the Treasurer of the Association, with interest thereon, should have been liquidated the Corporation should transfer to the Association all its right, title and interest in the 'Tully Sugar Mill : AND WHERE.AS the Association completed the liquidation of the aforesaid liability, with interest thereon, on or about the thirty-first day of December, 1958: AND WHEREAS "Tlie Tully S'l.l,{Jar Works Acts, 1930 to 1937," defined the Tully Sugar Mill to be " the Tully Sugar Mill, together with all machinery, chattels 537

No. 5, and appurtenances used therein or in connection therewith, and all tramwB,ys and railways leading thereto, and the mill site, and all land used in com1ection with any such tramway or railway": AND WHEREAS the Corporation deeming that the Tully Sugar Mill as so defined did not include the aforementioned sections 11 and 12 and certain other land vested in it as aforementioned surrendered the estate in fee-simple held by it in such lands to the Crown by an instrument of surrender registered in the office of the Deputy Registrar of Titles at '1 1 ownsville on the eighth day of December, 1959 : AND WHEREAS residences provided by the Association for its employees at or in connection with the Tully Sugar Mill are situated upon the said sections 11 and 12 and the Association has managed and controlled these sections since the transfer to it of the management and control of the Tully Sugar Mill : AND WHEREAS it is desirable that the said sections 11 and 12 should be included in and form part of the property appurtenant to the Tully Sugar Mill: Short title. Be it therefore enacted by the Queen~s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as" The Tully Sugar Mill (Lands Grant) Act of 1961." Grant to the Association. 2. The Governor in Council shall, in the name of Her Majesty, grant to the Tully Sugar Milling Co-operative Association Limited for .an estate in fee-simple the land situated in the County of Cardwell,
10 ELIZ. IL No. 5, 1961. Tully Sugar llliU (Lands Grant) Act. Parish of Rockingham, Town of Tully, described as sections 11 and 12, and subject to the Association paying the appropriate deed and assurance fees, shall issue two Deeds of Grant comprising respectively the said section 11 and the said section 12. Such grant shall be made, and such Deeds of Grant shall issue, subject to the several conditions and reservations contained in and declared by " The Land Acts, 1910 to 1960," "The Mining on Private Land Acts, 1909 to 1956," and "The Petroleum Acts, 1923 to 1958." 539 By Authority: S.
