Application for approval of the Tuff Enterprises Pty Ltd Enterprise Agreement 2014.

[1] An application has been made for approval of an enterprise Agreement known as the Tuff Enterprises Pty Ltd Enterprise Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Tuff Enterprises Pty Ltd. The Agreement is a single-enterprise Agreement.

[2] On reviewing the application the Commission sought clarification about the entitlements proposed to be provided to employees required to work at weekends compared to the entitlements provided for in the Security Services Industry Award 2010. The Applicant’s representative subsequently proposed that an undertaking be provided by the employer in response to this matter. Detailed examples were also provided about how the proposed undertaking would work in practice in terms of the pay rates to be provided to employees.

[3] I am satisfied that the proposed undertaking will not cause financial detriment to the employees who are to be covered by the Agreement. I am also satisfied it will not result in substantial changes to the Agreement. The undertaking given by the employer is accordingly accepted and its terms will form part of the Agreement. A copy is also attached to this decision.

[4] I am also satisfied that each of the requirements of ss.186, 187,188 and s.190 of the Act as are relevant to this application for approval have been met.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 4 July 2014. The nominal expiry date of the Agreement is 3 July 2018.
