AN ACT to amend Sections Five and Forty-five of

the Trustees Act, 1900-1951.

[Assented to 28th November, 1955.]

BE it enacted, by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Trustees

Short title

and citation.

Act Amendment Act, 1955.

(2) In this Act the Trustees Act, 1900-1951,

Act 64 Victories No. 17 as amended by Acts Nos. 7 of 1927 and 38 of 1951 and affected by Acts

No. 35.]

Nos. 10 of 1924, 4 of 1926, 9 of 1931, 10 of 1931 and 4 of 1935,

is referred to as the principal Act.

(3) The principal Act as amended by this Act

may be cited as the Trustees Act, 1900-1955.

Section five of the principal Act is amended

by adding after paragraph (i) a paragraph as

follows:—

(j) with the approval of the Court and on such terms and conditions as the Court thinks fit, in the purchase of real estate for the purpose of providing a home for any bene- ficiary under the trust.

Section forty-five of the principal Act is

amended by adding after paragraph (vi) of subsec-

tion (1) a paragraph as follows:

(vii) The varying from time to time of the amount of any payment (whether by way of annuity or otherwise) being made peri- odically to any beneficiary, where the Court is of opinion, having regard to all the cir- cumstances of the case, that it is just and equitable that the amount be varied.
