139' (Q11tt1tS = br ANNO DUODECIMO ELIZABETHAE -SECUNDAE REGINAE No. 24 of 1963 An Act to Amend "The Queensland Trustees, Limited, Acts, 1888 to 1961," in a certain particular and to make provision consequential on the amalgamation of certain Trustee Companies incorporated within the State of Victoria one of which carries on business within the State of Queensland ; and for purposes connected therewith [ASSENTED TO 12TH DECEMBER, 19631 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as " The Trustee Companies Act of 1963." 2. Parts of Act. This Act is divided into Parts as follows:- PART I-PRELIMINARY; PART II-AMENDMENT OF " THE QUEENSLAND TRUSTEES, LIMITED, ACTS, 1888 TO 1961 "; PART 111-PROVISIONS WITH RESPECT TO " THE UNION TRUSTEE COMPANY OF AUSTRALIA, LIMITED, ACTS; 1890 TO 1961," AND FOR PURPOSES CONNECTED THEREWITH.

140 Trustee Companies Act of 1963, No. 24 PART II-AMENDMENT OF " THE QUEENSLAND TRUSTEES, LIMITED, ACTS, 1888 TO 1961" 3. (1) Construction of Part II. This Part II of this Act shall be read as one with " The Queensland Trustees, Limited, Acts, 1888 to 1961." (2) Collective title . " The Queensland Trustees, Limited, Acts, 1888 to 1961," and this Part II of this Act may be collectively cited as " The Queensland Trustees, Limited, Acts, 1888 to 1963." 4. Amendment of s. 22 . Section twenty-two of " The Queensland Trustees Limited Act, 1888," is amended by inserting in paragraph (a), after the words " No member ", the words " other than the corporation incorporated according to the law of the State of New South Wales relating to companies on the thirty-first day of July, one thousand nine hundred and sixty-three and called Perpetual Trustees Australia Limited ". PART III-PROVISIONS WITH RESPECT TO " THE UNION TRUSTEE COMPANY OF AUSTRAL. A, LIMITED, ACTS, 1890 TO 1961," AND FOR PURPOSES CONNECTED THEREWITH 5. (1) Construction of Part III This Part III of this Act shall be read as one with " The Union Trustee Company of Australia, Limited, Acts, 1890 to 1961." (2) Collective title . " The Union Trustee Company of Australia, Limited, Acts, 1890 to 1961," and this Part III of this Act may be collectively cited as " The Union Trustee Company of Australia, Limited, Acts, 1890 to 1963." b. Interpretation . (1.) Any reference to " The Union Trustee Company of Australia, Limited " in any Act, instrument (including but without limiting the generality hereof, any title to an estate or interest in land), will, codicil, grant, order, document or paper whatsoever shall as from the commencement of " The Trustee Companies Act of 1963," be read and construed as a reference to " The Union-Fidelity Trustee Company of Australia Limited ". (2.) In the case of any estate or interest in land registered in the name of The Union Trustee Company of Australia Limited at the time of the passing of this Act the Registrar of Titles where " The Real Property Acts, 1861 to 1960," apply to such estate or interest in land or the person or authority charged with registering instruments of title to or dealings with that estate or interest where the said The Real Property Acts do not apply thereto shall without any authority other than this section have power and authority to make and shall cause to be made and he or it is hereby directed to make or cause to be made any necessary entries or endorsements in the appropriate register book or other record of titles or dealings and to do and execute all such acts matters and things as may be necessary and proper to give full effect to the object and purposes of this section and in particular shall without any payment of fee register any such estate or interest in land registered in the name of The Union Trustee Company of Australia Limited at the time of the passing of this Act in the name of The Union-Fidelity Trustee Company of Australia Limited. (3.) Without derogating from or otherwise affecting the provisions of subsection (1.) of this section the name of the registered proprietor or holder of any estate or interest in land registered in the name of The Union Trustee Company of Australia Limited at the time of the passing

Trustee Companies Act of 1963, No. 24 141 of this Act shall, so long as the estate or interest remains registered in that name , be deemed to be The Union - Fidelity Trustee Company of Australia Limited for the purposes of any Act relating to estates or interests in land and in particular for the purpose of all dealings with any such estate or interest subsequent to the passing of this Act. (4.) With respect to any registration of change of name directed by this ' section , the Registrar of Titles , or as the case may be, the person or authority charged with the registration of instruments of title to or dealings with any estate or interest in land as hereinbefore in this section mentioned , unless sooner requested so to do by The Union - Fidelity Trustee Company of Australia Limited , shall not be bound to register the same until the first dealing in respect of the estate or interest in land is lodged , filed or deposited in the Real Property Office or other appropriate office as the case may be together with all other documents requisite for the due registration of that dealing. (5.) The change of name of The Union Trustee Company of Australia , Limited to The Union - Fidelity Trustee Company of Australia Limited shall not affect the identity of the Company or any rights or obligations of the Company or render defective any legal proceedings by or against the Company , and any legal proceedings that might have been continued or commenced by or against the Company by its former name may be continued or commenced by or against it by its new name.
