1482 Trust (Reserve 1030) Variation Act 1989, No. 109 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Trust (Reserve 1030) Variation Act 1989. 2. Commence m ent. (1) Section 1 and this section commence on the day this Act is assented to for and` on behalf of Her Majesty. (2) Except as provided by subsection (1) the provisions of this Act, or such as may be specified, commence on a day or days appointed by Proclamation. 3. Definition. In this Act except where the contrary intention appears- "Brisbane City Council" means the Brisbane City Council constituted within the meaning of the City of Brisbane Act1924-1987; "subject land" means the land described as Lot 669 on Plan Catalogue Number B.3.555 registered in the Department of Geographic Information, Brisbane being Reserve 1030 in accordance with the Order in Council of 12 June 1914 as published in Govern-_:.c.nt Gazette of 13 June 1914 page 1540 as depicted .n e - nliedule. 4. Discharge of trust. As -or:- the day of commencement of this section- (1) the subject land iu frcc!1 ilom all or any trust or reservation whether under "The Paddington Cemeteries Act of 1911 " or otherwise that applied to that land immediately prior to that day; (2) that portion of the subject land as hachured on the plan in the Schedule is vested in the Crown and thereupon dedicated as a road for public use within the meaning of the Land Act 1962-1988; that portion of the subject land other than the land hachured on plan in the SchedCc is permanently reserved from public use vested, under t'-3 Cc.-.d Act 1962-1988, in the Brisbane City as trustee for the rvation of memorials. The land described in section 4 (3) is teable land for the purpose of the City of Brisbane Act 1924-1987 Local Government Act 1936-1989.
Trust ( Reserve 1030 ) Variation Act 1989, No. 109 1483 7. Removal of memorials . As soon as practicable after the day of commencement of section 4 the Brisbane City Council must, prior to any other work commencing, remove any memorial from the land described in section 4 (2) and, at its expense, place such memorial on the land described in section 4 (3).
