The applicant requires an extension of time in order to seek special leave to appeal against a decision of the Court of Appeal of the Supreme Court of Victoria (Maxwell P, Beach and McLeish JJA) allowing an appeal by the respondent in respect of the sentence imposed by the sentencing judge (Judge Trapnell) for offences contrary to s 233BAB(5) of the Customs Act 1901 (Cth) and ss 11.1(1) and 361.2 of the Criminal Code (Cth).
It would not be in the interests of justice in the circumstances of this case to grant special leave. There is no reason to doubt the correctness of the Court of Appeal's decision. Accordingly, it would be futile to grant the extension of time sought.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
