1  Name

This instrument is the Treatment Benefits (Special Access) (Modifications of the Repatriation Private Patient Principles) Instrument 2019.

2  Commencement

This instrument commences on 1 July 2019.

3  Authority

This instrument is made under section 19 of the Treatment Benefits (Special Access) Act 2019.

4  Schedule—Modifications of the Repatriation Private Patient Principles

The Repatriation Private Patient Principles are modified as set out in the Schedule to this instrument for the purposes of the Treatment Benefits (Special Access) Act 2019.

Repatriation Private Patient Principles

1  Paragraphs 1.1 and 1.1A

Omit the paragraphs, substitute:

1.1  Name

This instrument is the Principles.

1.1A  Commencement

This instrument commences on 1 July 2019.

2  Paragraph 1.2 (definition of Act)

Substitute:

Act means the Treatment Benefits (Special Access) Act 2019.

3  Paragraph 1.2 (definition of Commission)

Substitute:

Commission means the Repatriation Commission continued in existence by section 179 of the Veterans’ Entitlements Act 1986.

4  Paragraph 1.2 (definition of dependent of a Vietnam veteran)

Omit the definition.

5  Paragraph 1.2 (definition of entitled person)

Substitute:

entitled person means an eligible person within the meaning of the Act.

6  Paragraph 1.2 (definition of former Repatriation Hospital)

Substitute:

former Repatriation Hospital means a hospital or other institution that was formerly operated by the Commission under paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986.

7  Paragraph 1.2 (definition of Principles)

Substitute:

Principles means the Repatriation Private Patient Principles as modified by the Treatment Benefits (Special Access) Modifications of the Private Patient Principles Instrument 2019.

8  Paragraph 1.2 (definition of private patient)

Substitute:

private patient has the same meaning given by subsection 19(8) of the Act.

9  Paragraph 1.2 (definition of revoked Repatriation Private Patient Principles)

Omit the definition.

10 Paragraph 1.2 (definition of Treatment Principles)

Substitute:

Treatment Principles means the Treatment Principles as modified by the Treatment Benefits (Special Access) (Modifications of the Treatment Principles) Instrument 2019.

11 Paragraph 1.2 (definition of veteran partnering private hospital)

Omit “the Act”, substitute “the Veterans’ Entitlements Act 1986”.

12 Paragraph 1.2 (definition of Vietnam veteran)

Omit the definition.
