901 ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGINAE No. 82 of 1974 An Act to provide for the establishment and functions of, a Treaties Commission and for purposes incidental thereto [ASSENTED TO 1ST NOVEMBER, 19741 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Citation . This Act may be cited as the Treaties Commission Act 1974. 2. Constitution of Commission . There shall be constituted from time to time a body to be called the Treaties Commission, which shall perform the functions with which it is charged by this Act. 3. Members of Commission . The Treaties Commission shall consist of not less than three nor more than six members appointed by the Governor in Council by notification published in the Gazette. 4. Term of membership of Commission . A member of the Treaties Commission shall hold his appointment as such during the pleasure of the Governor in Council and may be removed therefrom by notification published in the Gazette but may at any time resign his appointment by writing given to the Minister. 5. Remuneration of members . The members of the Treaties Commission may be paid such allowances and fees as the Governor in Council approves from time to time.
902 Treaties Commission Act 1974, No. 82 6. Functions of Commission . The functions of the Treaties Commission shall be- (a) to examine international treaties and conventions, whether or not they are in force at the material time, with a view to assessing their benefit to and effect on Queensland; (b) to report from time to time and as may be expedient to the Parliament of Queensland upon legislation which would be necessary or desirable to give effect in Queensland to undertakings entered into or to be entered into by the Government of the Commonwealth of Australia pursuant to international treaty or convention and to make recommendations with respect to the substance and form of such legislation; (c) to advise the Government of Queensland with respect to international treaties and conventions whether or not- (i) the Commonwealth of Australia is a party thereto; or (ii) the treaties or conventions are in force at the material time, and to make recommendations to the Government of Queensland concerning co-operation with the Government of the Commonwealth of Australia in the implementation of international treaties and conventions. 7. Co-operation with like bodies. The Treaties Commission may, in the discharge of its functions, act in aid of and co-operate with any other body or entity established by the Government of the Commonwealth of Australia or of any State thereof and having functions similar to those of the Commission under this Act.
