I, THE
GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, hereby make the following Regulations
tinder the

Amendments of the Treasury Regulations
“ (2.) A reference in these Regulations to directions given by the Secretary shall be read as a reference to directions given by the Secretary to the Department of the Treasury under regulation 127a of these Regulations.”.
(
a ) by omitting from sub-regulation (1.) the words “ the Chief ” (first occurring) and “ the person ” and inserting in their stead the words “ a Chief ” and “ a person ”, respectively;(
b ) by omitting from sub-regulation (2.) the words “ the Chief ” (first occurring) and “ the person ” and inserting in their stead the words “ a Chief ” and “ a person ”, respectively; and(
c ) by adding at the end thereof the following sub-regulation:—“ (3.) The Minister of State administering an Act under which an authority of the Commonwealth is established may appoint a person to be, for the purposes of these Regulations, a Chief Accounting Officer for that authority in a State or Territory, and a reference in a provision of these Regulations to the Chief Accounting Officer shall, in the application of that provision to, or in relation to, matters arising in relation to that authority in that State or Territory, be read as a reference to a person so appointed.”.

a ) by omitting the word “ Where ” and inserting in its stead the words “ Subject to the next succeeding regulation, where ”; and(
b ) by omitting the words “, unless the Treasurer otherwise directs,”.

(
a ) by omitting from sub-paragraph (ix) of paragraph (e ) of sub-regulation (2.) the words “ (including launches of the Department of Customs and Excise) ”;
(b) by omitting from sub-paragraph (xiii) of that paragraph the word “ and ” (second occurring); and(
c ) by adding at the end of that paragraph the following sub-paragraphs:—“ (xv) supplies obtained by or on behalf of the Administrator of the Territory of Christmas Island in connexion with the Administration of the Territory;
(xvi) supplies approved, or to be obtained by, the Tender Board of the Department of the Interior; and
(xvii) supplies of radioactive isotopes for medical purposes from sources within Australia to be obtained by the Commonwealth X-ray and Radium Laboratory of the Department of Health.”.
“ 53.—(1.)
Subject to this regulation, where a contract for supplies is entered into by,
or on behalf of, the Commonwealth and the total liability of the Commonwealth
under the contract for those supplies will be not less than. Four hundred
dollars, the Chief Officer of the Department that required the supplies, or, if
tenders for the contract were considered by a Tender Board, the Chairman of
that Board, shall publish, or cause to be published, in the
“ (2.) The last preceding sub-regulation does not apply where—
(
a ) the contract is a contract for supplies to be supplied by a Department of a State, by a State Government Printer or by an authority or body established by or under a State Act;(
b )the contract has been made with a person who has entered into a contract in respect of supplies of the same kind with a State or an authority or body established by or under a State Act and the contract with the Commonwealth provides for the supplies to be supplied to the Commonwealth on the same terms and conditions as are contained in the contract with the State or with such an authority or body;(c) the contract has been made for supplies required by the Administration of the Northern Territory of Australia and a summary of the provisions of the contract has been published in the
Northern Territory of Australia Government Gazette; or(
d )the Chief Officer of the Department that required the supplies, or, if the tenders for the contract were considered by a Tender Board, the Chairman of that Board, determines that the terms of the contract are such, or the contract is for supplies of such a kind, that, in the public interest, the provisions of the contract should not be so published.
“ (3.) Subject to any directions given by the Secretary, where a contract referred to in sub-regulation (1.) of this regulation has been made, the Chief Officer of the Department that required the supplies or, if tenders for the contract were considered by a Tender Board, the Chairman of that Board, may authorize the disclosure to such persons as the Chief Officer or the Chairman thinks fit of such information relating to that contract as the Chief Officer or the Chairman thinks fit.”.
(
a )by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—“ (1.) Except as otherwise provided by directions given by the Secretary, payment of an account shall be made by cheque.”;
(
b )by omitting from sub-regulation (2.) the words “ The payment ” and inserting in their stead the words “ Subject to the next succeeding sub-regulation, the payment ”;(
c ) by omitting paragraph (c ) of sub-regulation (2.) and inserting in its stead the following paragraph:—“ (
c ) to a person authorized by the claimant to receive payment; ”; and(
d ) by omitting sub-regulations (3.) and (4.) and inserting in their stead the following sub-regulation:—“ (3.) Payment of an account shall only be made in accordance with paragraph (
b ) or paragraph (c) of the last preceding sub-regulation in the circumstances set out in, and in accordance with, directions given by the Secretary.”.
“ 99.—(1.) The Chief Accounting Officer for a Department or an officer authorized by him for the purposes of this regulation shall, subject to, and in accordance with, any directions given by the Secretary, at least once in each month or at such more frequent intervals as are necessary to enable him to carry out his duties under these Regulations, obtain, in respect of each account kept by the Department at a bank, from the bank at which the account is kept—
(
a ) all cheques drawn on the account and paid by the bank during the period that has elapsed since last he obtained cheques of that kind; or(
b ) a statement setting out the particulars of cheques so paid during the period that has elapsed since last he obtained such a statement,
or, if the directions given by the Secretary so require, both the cheques so paid and a statement setting out the particulars of the cheques so paid during such a period.
“ (2.) The Chief Accounting Officer for a Department or an officer authorized by him for the purposes of this regulation shall, subject to, and in accordance with, any directions given by the Secretary—
(
a )obtain, in respect of each account kept by the Department at a bank, from the bank at which the account is kept, at least once in each month, a certificate setting out the balance of the moneys standing to the credit of the Department’s account; and(
b ) reconcile the balance of those moneys as set out in the certificate with the balance of the moneys that the records of the Department show as standing to the credit of the account.”.
“ 104. A Paymaster shall, in accordance with directions given by the Secretary, record payments into and from each Drawing Account operated by him.”.
(
a ) by omitting the words “ the Treasurer ” and inserting in their stead the words “ the Secretary ”; and(
b ) by omitting sub-regulation (2.).
(
a )by inserting after sub-regulation (1.) the following sub-regulation:—“ (1a.) Where—
(
a ) in pursuance of a direction given under a provision of these Regulations, that provision does not apply in the circumstances specified in the direction; or(
b ) the operation of a provision of these Regulations depends on a direction or approval referred to in that provision and such a direction or approval is given,the power conferred by the last preceding sub-regulation extends to the giving of directions, not inconsistent with the Act, with any other Act, or with any other regulations under the Act or any other Act, in relation to the matter dealt with by that provision.”; and
(
b ) by omitting from sub-regulation (3.) the words “ either of the last two preceding sub-regulations ” and inserting in their stead the words “ this regulation ”.
