REGULATIONS UNDER THE AUDIT ACT 1901-1973. *

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Audit Act 1901-1973.

Amendments of the Treasury Regulations 

Parts.

1. Regulation 3 of the Treasury Regulations is amended by omitting the words—

“ Division 4—Commonwealth Sub-Treasuries (Regulations (123-126) ”, and substituting the words—

 Division 4—Sub-Treasuries (Regulations 123-126) ”.

Interpretation.

2.Regulation 4 of the Treasury Regulations is amended—

(a) by omitting paragraph (a) of the definition of “ Chief Officer ” in sub-regulation (1) and substituting the following paragraphs:—

“ (a) a person who is, or is performing the duties of, the Permanent Head of a Department;

“ (aa) the person for the time being holding, or performing the duties of, an office established by or under an Act, the holder of which has all the powers of, or exercisable by, a Permanent Head under the Public Service Act 1922-1973 in respect of a branch of the Australian Public Service;

“ (ab) a person who is, or is performing the duties of, the Chief Executive Officer of an authority established under an Act;”;

(b) by omitting from sub-regulation (1) the definition of “Sub-Treasury” and substituting the following definition:—

“ ‘ Sub-Treasury ’ means an office of the Department of the Treasury established under regulation 123 or deemed to be an office of the Department of the Treasury established under that regulation;”.

Repeal of regulation 17.

3. Regulation 17 of the Treasury Regulations is repealed.

4. Regulation 41 of the Treasury Regulations is repealed and the following regulation substituted:—

Duplicate receipt.

“ 41. (1) Where an officer has given a receipt or acknowledgment inaccordance with regulation 39 for moneys received, the officer may, if the Secretary permits, give a duplicate of that receipt or acknowledgment or give another receipt or acknowledgment for those moneys but any such other receipt or acknowledgment shall not be given on a form referred to in that regulation.

“ (2) A reference in this regulation to the Secretary shall be read as including a reference to a person holding an office in the Department of the Treasury of Deputy Secretary or First Assistant Secretary.”.

Quotations.

5. Regulation 51 of the Treasury Regulations is amended by omitting paragraph (a) of sub-regulation (1) and substituting the following paragraph:—

“ (a) any supplies the estimated cost of which exceeds Fifty dollars are required; ”.

Certifying Officer to keep Register of Salaries.

6. Regulation 58a of the Treasury Regulations is repealed.

Petty cash expenditure.

7. Regulation 60 of the Treasury Regulations is amended by omitting from sub-regulation (2) the words “ Two dollars ” and substituting the words “ Five dollars ”.

Expenditure not to be authorized until Warrant Authority obtained.

8. Regulation 90 of the Treasury Regulations is amended by omitting from sub-regulation (1) the words “ Revenue or Loan appropriations ” and substituting the words “ an appropriation of the Consolidated Revenue Fund (other than an appropriation that is to be deemed to be made by virtue of section 35 of the Act) or an appropriation of the Loan Fund ”.

Payments from Trust Fund.

9. Regulation 91 of the Treasury Regulations is amended by omitting sub-regulation (1).

Payments authorized not to exceed Trust Fund Credit or Warrant Authority.

10. Regulation 92 of the Treasury Regulations is repealed.

11. Regulation 107 of the Treasury Regulations is repealed and the following regulations substituted:—

Record of payment of salaries.

“ 107. The prescribed form of a certificate for the purposes of sub-section (6c) of section 34 of the Act is Form 15.

Arrangements for payment of salaries.

“ 107a. (1) A Chief Officer shall submit to the Treasurer particulars of the arrangements proposed to be followed for the payment of salaries, wages and allowances.

“ (2) The Treasurer may, by instrument in writing—

(a) approve arrangements relating to the payment of salaries, wages and allowances submitted to him in pursuance of sub-regulation (1); or

(b) vary those arrangements and approve them as varied by him.

“ (3) Where, under sub-regulation (2), arrangements relating to the payment of salaries, wages and allowances have been approved by the Treasurer, a person shall not pay those salaries, wages or allowances otherwise than in accordance with those arrangements.”.

 

12. Regulation 111 of the Treasury Regulations is repealed and the following regulation substituted:—

Payment of accounts.

“ 111. (1) Subject to sub-regulation (2), the Paymaster shall post or deliver each cheque drawn by him to the payee of the cheque.

“ (2) The appropriate Chief Officer, or an officer authorized by him by instrument in writing for the purposes of this regulation, may authorize a Paymaster to post or deliver a cheque to a person other than the payee of the cheque.

“ (3) Where a Paymaster posts a cheque in payment of an account, be shall post it in an envelope bearing a direction that the envelope is to be returned to the Paymaster at a specified address if it is undelivered.”.

Repeal of regulation 115.

13. Regulation 115 of the Treasury Regulations is repealed.

14. (1) Regulation 123 of the Treasury Regulations and the heading immediately preceding that regulation are repealed and the following heading and regulation substituted:—

Division 4—Sub-Treasuries

Establishment of Sub-Treasuries.

“ 123. The Treasurer may establish offices of the Department of the Treasury at such places as he thinks fit.”.

(2) Each of the following shall be deemed to be an office of the Department of the Treasury established under regulation 123 of the Treasury Regulations: —

(a) a Sub-Treasury established under the Regulations repealed by the Treasury Regulations; and

(b) a Sub-Treasury or Commonwealth Sub-Treasury established under the Treasury Regulations as in force at any time before the commencement of these Regulations.

Power of Secretary to the Department of the Treasury and Chief Officer to give directions to Accounting Officers.

15. Regulation 127a of the Treasury Regulations is amended by omitting from sub-regulation (2) the words “ the last preceding sub-regulation ” and substituting the words “ sub-regulation (1) ”.

Prescribed amount for the purposes of section 37b.

16. Regulation 129a of the Treasury Regulations is amended by omitting the words “ Six hundred dollars ” and substituting the words “ Two thousand dollars ”.

Schedule.

17. The Schedule to the Treasury Regulations is amended—

(a) by omitting the words “ THE SCHEDULE ” and substituting the word “ SCHEDULE ”;

(b) by inserting, after Form 13, the form in the Schedule; and

(c) by omitting Form 25.
