1964. No. 21.

REGULATIONS UNDER THE AUDIT ACT 1901-1962.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Audit Act 1901-1962.

Amendments of the Treasury Regulations. 

Definitions.

1. Regulation 4 of the Treasury Regulations is amended by inserting in the definition of "supplies", after the word "for", the words "or by".

2. Regulation 5 of the Treasury Regulations is repealed and the following regulation inserted in its stead:—

Forms.

"5.—(1.) In these Regulations, a reference to a form by number shall be read as a reference to the form so numbered in the Schedule to these Regulations.

"(2.) Where under these Regulations a statement, return or other document is required to be in accordance with a form in the Schedule to these Regulations, the Treasurer may, either generally or in a particular case or class of cases, authorize the statement, return or other document to be in accordance with a form that differs from the first-mentioned form".

Payment by cheques drawn on certain accounts.

3. Regulation 21 of the Treasury Regulations is amended by omitting sub-regulation (1.).

Where certain forms may be obtained.

4. Regulation 42 of the Treasury Regulations is amended by omitting paragraph (b)of sub-regulation (1.) and inserting in its stead the following paragraph:—

"(b)postage stamps, income tax stamps, Treasury Bonds, Treasury Bills and cheque forms shall be obtained from the Note Printing Branch of the Reserve Bank of Australia; and".

Responsibilities of Certifying Officers.

5. Regulation 45 of the Treasury Regulations is amended by omitting paragraphs (f) and (g)of sub-regulation (1.) and inserting in their stead the following paragraphs:—

"(f) where an account makes provision for the total amount of the claim to be written in words in full—that the amount is so written;

"(g)that lines are drawn in any space in the part of an account in which the total amount of the claim is expressed (whether in words or figures, or both) so as to prevent any alteration to that amount; and".

6. Regulations 46 to 52 (inclusive) of the Treasury Regulations are repealed and the following regulations inserted in their stead:—

Requisitions for supplies.

"46.—(1.) A Requisition for supplies—

(a) shall relate only to supplies that are necessary for the proper conduct of the public service;

(b)shall be prepared—

(i) in the case of supplies that are to be obtained from or through the Department of Works and the appropriation for which is under the control of that Department—in accordance with a form determined by the Minister of State for Works; or

(ii) in any other case—in accordance with Form 11; and

(c) shall contain a description of the supplies, stating, where appropriate, the quantity of the supplies.

"(2.) A Requisition for supplies shall specify the contract under which the supplies are to be obtained and the contract price expressed, where practicable, as a rate.

"(3.) Where supplies specified in a Requisition can be obtained under an existing contract between the Commonwealth and a supplier, those supplies shall not be obtained otherwise than under that contract or, if there is more than one such contract, under one or more of those contracts.

Availability of funds.

"47.—(1.) A Requisition for supplies (other than a Requisition to which the next succeeding regulation applies) shall be submitted to the appropriate Authorizing Officer for a certificate whether funds are available for the purposes of the Requisition.

"(2.) The last preceding sub-regulation does not apply in relation to a Requisition if—

(a) an Authorizing Officer has, with the approval of the Treasurer, before the issue of the Requisition, given a certificate that an amount specified in the certificate is available for expenditure on supplies required for a purpose specified in the certificate;

(b) the Requisition relates to supplies that are required for that purpose; and

(c) the sum of—

(i) the amount specified in the Requisition to be the cost or estimated cost of the supplies specified in the Requisition; and

 (ii) any amounts specified in previous Requisitions covered by the certificate to be the cost or estimated cost of supplies specified in those Requisitions,

does not exceed the amount specified in the certificate to be available.

Availability of funds in certain cases.

"48.—(1.) A Requisition for supplies that are to be obtained from or through the Department of Works and the appropriation for which is under the control of that Department shall be submitted for approval to the Minister of State administering the Department from which the Requisition originated or to an officer appointed by that Minister for the purpose and shall not be sent to the Department of Works until that approval has been obtained.

"(2.) After the approval has been obtained, the Requisition shall be submitted to an Authorizing Officer for the Department of Works for a certificate whether funds are available.

Approval of Requisitions.

"49. When an Authorizing Officer has certified that funds are available for the purpose of a Requisition or has given a certificate of a kind referred to in paragraph (a) of sub-regulation (2.) of regulation 47 of these Regulations by virtue of which a certificate whether funds are available for the purpose of a Requisition is not required, the Requisition shall be submitted for approval—

(a)in the case of a Requisition for supplies the appropriation for which is under the control of a Department of the Parliament—to the President of the Senate or the Speaker of the House of Representatives or both, as the case requires, or to an officer appointed for the purpose by the President or the Speaker or both, as the case requires;

(b)in the case of a Requisition to which the last preceding regulation applies—to the Minister of State for Works or to an officer appointed by that Minister for the purpose; or

(c) in any other case—to the Minister of State administering the Department in which the Requisition originated or to an officer appointed by that Minister for the purpose.

Expenditure in cases of emergency.

"50.—(1.) In cases of emergency, expenditure in respect of the purchase of articles of small value, the transport of parcels or the performance of other minor services may be incurred, before the issue of a Requisition in respect of that expenditure, by a person referred to in the last preceding regulation to whom the Requisition, when issued, is to be submitted for approval in accordance with that regulation.

"(2.) Where expenditure is so incurred, the Certifying Officer shall enter the details of the transaction to which the expenditure relates in a book to be kept by him for the purpose.

"(3.) The amount of expenditure that may be incurred under this regulation on any one occasion shall not exceed—

(a)in the case of expenditure on articles or services included in a class of articles or services in relation to which the Treasurer has determined the maximum amount of expenditure that may be incurred—the amount so determined; or

(b)in any other case—Twenty-five pounds.

 

Quotations.

"51.—(1.) Subject to any Act making provision with respect to contracts for supplies, where—

(a)any supplies are required;

(b)there is no existing contract between the Commonwealth and a supplier under which the supplies so required can be obtained; and

(c) the supplies are not obtained under a contract between a State and a supplier,

representative quotations for the supplies shall, whenever possible, be obtained unless tenders are publicly invited.

"(2.) The minimum number of representative quotations to be obtained is—

(a)if the estimated cost of the supplies exceeds Twenty-five pounds but does not exceed Two hundred pounds—three; or

(b)if the estimated cost of the supplies exceeds Two hundred pounds—five.

"(3.) Where the estimated cost of any supplies exceeds Twenty-five pounds but does not exceed Fifty pounds, a quotation obtained under this regulation in respect of the supplies may be oral or in writing, but, in the case of an oral quotation, the details of the quotation shall be recorded in the appropriate Departmental file.

"(4.) Where the estimated cost of any supplies exceeds Fifty pounds, each quotation obtained under this regulation in respect of those supplies shall be in writing.

Tenders.

"52.—(1.) Subject to any Act making provision with respect to contracts for supplies and subject to the next succeeding sub-regulation, contracts shall not be entered into, and orders shall not be placed, for supplies the estimated cost of which exceeds Five hundred pounds unless tenders have first been publicly invited for those supplies.

"(2.) The last preceding sub-regulation does not apply to—

(a) supplies the expenditure on which is authorized by the Governor-General;

(b) supplies to be obtained under an existing contract between a supplier and the Commonwealth or a State;

(c)supplies to be obtained from the Commonwealth Government Printing Office, a State Government Printing Office, Commonwealth factories, Commonwealth workshops, Commonwealth stores or Commonwealth dockyards;

(d)supplies that by their nature can be obtained only from a State Government Department, an authority of a State or a municipal or other local governing body; and

 (e) particular supplies in respect of which the Secretary to the Department of the Treasury, or an officer authorized by him in writing for the purpose, certifies that the inviting of tenders is impracticable or inexpedient, being supplies of a kind referred to in any of the following sub-paragraphs:—

(i) silver or base metals to be purchased for the manufacture of Australian coinage;

(ii) supplies relating to the defence of the Commonwealth;

(iii) supplies for the Department of Works;

(iv) supplies approved, or to be obtained, by the Commonwealth Stores Supply and Tender Board;

(v) supplies approved, or to be obtained, by the Contract Board of the Department of Supply;

(vi) supplies approved, or to be obtained, by a Tender Board of the Postmaster-General's Department;

(vii) supplies approved, or to be obtained, by the Stores and Tender Board of the Department of Territories at Sydney;

(viii) works of art for the Australian War Memorial;

(ix) supplies for the Marine Branch of the Department of Shipping and Transport in connexion with the overhaul of or repairs to vessels, boats or launches (including launches of the Department of Customs and Excise);

(x) emergency supplies for aerodromes or airways facilities or, in respect of specific aircraft accidents, for accident investigation or search or rescue operations;

(xi) supplies approved, or to be obtained, by a Procurement and Contract Board of the Repatriation Department;

(xii) supplies approved, or to be obtained, by the Northern Territory Administration Tender Board; and

(xiii) supplies approved, or to be obtained, by a Tender Board of the Commonwealth Scientific and Industrial Research Organization.

Orders for approved supplies.

"52a.—(1.) When—

(a)an Authorizing Officer has—

(i) certified that funds are available for the purpose of a Requisition; or

(ii) given a certificate of a kind referred to in paragraph (a)of sub-regulation (2.) of regulation 47 of these Regulations by virtue of which a certificate whether funds are available for the purpose of a Requisition is not required; and

 (b)the Requisition has been approved after submission for approval under regulation 49 of these Regulations,

the appropriate Chief Officer, or an officer authorized for the purpose by the appropriate Chief Officer, shall issue a Purchase Order in accordance with Form 13 in respect of the supplies specified in the Requisition.

"(2.) Unless the Treasurer otherwise approves, Purchase Orders shall be prepared in triplicate and shall be numbered consecutively.

"(3.) A Purchase Order shall not be issued except in accordance with the Requisition as approved.

Duties of Certifying Officers in relation to Requisitions.

"52b.—(1.) Immediately after the issue of a Purchase Order, the officer who issued the Order shall forward the Requisition for the supplies to which the Purchase Order relates to the Certifying Officer.

"(2.) The Certifying Officer shall not, except where the Treasurer otherwise approves, certify an account for expenditure in respect of supplies specified in a Purchase Order unless the duplicate of the Purchase Order upon which the officer responsible for receiving, or for the execution or performance of, the supplies has certified that the supplies are, or have been executed or performed, in accordance with the Purchase Order is attached to the account and the Order number is quoted on the account.

"(3.) The Certifying Officer shall make a memorandum on both the Requisition and on the duplicate of the Purchase Order that the account has been certified.".

7. Regulation 56b of the Treasury Regulations is repealed and the following regulations are inserted in its stead:—

Preparation of statement of variations in pay, &c., and the reasons therefor.

"56aa.—(1.) A Chief Officer, or an officer authorized by him to act under this regulation, shall—

(a) prepare, at such times as the Treasurer determines, a statement showing any variations in the pay, allowances and deductions from pay of officers under the control of the Chief Officer and the reasons for those variations; and

(b)forward to the appropriate Certifying Officer such number of copies of the statement as the Treasurer directs.

"(2.) A statement under this regulation shall be prepared in accordance with whichever of Forms 28a, 28b and 28c is directed by the Treasurer.

"(3.) A statement under this regulation shall not be prepared by an officer who prepares claims for salaries.

Preparation of certificates of statements of variations in pay, &c.

"56b.—(1.) A Chief Officer, or an officer authorized by him to act under this regulation, shall prepare fortnightly a certificate in accordance with Form 28 in respect of statements prepared under the last preceding regulation in relation to officers under the control of the Chief Officer and not included in a previous certificate prepared under this regulation.

"(2.) As soon as practicable after such a certificate has been prepared, the Chief Officer or the officer so authorized by him shall forward one copy of the certificate to the Chief Auditor and one copy of the certificate to the appropriate Certifying Officer.

"(3.) A certificate under this regulation shall not be prepared by an officer who prepares claims for salaries.".

8. Regulation 63a of the Treasury Regulations is repealed and the following regulation inserted in its stead:—

Pensions Registers.

"63a. A Certifying Officer who certifies accounts for pensions shall keep Pensions Registers in accordance with Form 26.".

Authorizing Officer or Chief Accounting Officer to examine certain moneys.

9. Regulation 98 of the Treasury Regulations is amended by omitting from sub-regulation (3.) the words "satisfy himself that" and inserting in their stead the words "ascertain whether".

Receipt for purposes of section 34 (6.) of Audit Act.

10. Regulation 116 of the Treasury Regulations is amended by adding at the end thereof the following sub-regulation:—

"(2.) This regulation applies in relation to a cheque issued by a Paymaster or any other accounting officer.".

Accounts kept by Departments to be subsidiary to Treasury accounts.

11. Regulation 127 of the Treasury Regulations is amended by omitting sub-regulations (3.) and (4.).

12. After regulation 127 of the Treasury Regulations the following regulation is inserted:—

Power of Secretary to the Department of the Treasury and Chief Officer to give directions to accounting officers.

"127a.—(1.) The Secretary to the Department of the Treasury may give to persons employed in the service of the Commonwealth or to any other persons who are subject to the provisions of the Act directions, not inconsistent with the Act or any other Act or with any regulations under the Act or any other Act, for or in relation to any of the matters referred to in paragraphs (a) to (f), inclusive, of sub-section (1.) of section 71 of the Act.

"(2.) A Chief Officer of a Department may give to officers of, or persons employed in, that Department directions, not inconsistent with the Act or any other Act, with any regulations under the Act or any other Act or with any directions given under the last preceding sub-regulation, for or in relation to any of the matters referred to in paragraphs (a) to (f), inclusive, of sub-section (1.) of section 71 of the Act.

"(3.) A contravention of, or failure to comply with, a direction given under either of the last two preceding sub-regulations shall be deemed to be a breach of these Regulations.".

Certain officers to acquaint themselves with Act, Regulations, &c.

13. Regulation 131 of the Treasury Regulations is amended by omitting the words "the Treasury Regulations and the Treasury Instructions on the Act and those Regulations" (wherever occurring) and inserting in their

stead the words "any directions given under section 16 of the Act, these Regulations and any directions given under regulation 127a of these Regulations".

14. Regulation 131a of the Treasury Regulations is repealed and the following regulation inserted in its stead:—

Act, Regulations and directions to be accessible to certain officers.

"131a. A Chief Officer shall—

(a) ensure that copies of the Act, of any directions given under section 16 of the Act, of these Regulations and of any directions given under regulation 127a of these Regulations, being copies of the Act, of these Regulations or of those directions as in force from time to time, are accessible to all officers who are under his control and perform duties in connexion with any of the matters referred to in paragraphs (a) to (f), inclusive, of sub-section (1.) of section 71 of the Act; and

(b)upon request made by the Auditor-General or an officer of the Auditor-General's Office, produce those copies to the Auditor-General or officer, as the case may be.".
