| t h e Treasury Bills A c t of 1870 and which will fall due in t h e m o n t h of Apr i l one thousand eight hundred and seventy-one Be it therefore enacted by the Queen ' s Mos t Exce l l en t Majesty by and wi th t h e advice and consent of t h e Legislat ive Council and Legislat ive Assembly of N e w South Wales in Pa r l i amen t assembled and by the au thor i ty of t he same as follows :— | |
| 1. The t e r m Governor in Council whenever used herein shall m e a n t h e Governor wi th t he advice of the Execu t ive Council A n d when any Governmen t officer is ment ioned here in t he person for t he t ime being ac t ing for such officer and duly author ized so to act shall be also implied. | |
| 2. The Governor in Council may at any t ime cause any n u m b e r of Treasury Bills to be made out by t h e Colonial Treasurer for any amoun t s of money no t exceeding in t he whole t he s u m of Three hundred and forty-three thousand two hundred pounds in m a n n e r and subject to t h e provisions hereinafter specified and contained. | |
| 3 . Al l such Treasury Bills shall be made out a t the Treasury in such me thod and form and wi th such cheques indents and counterfoils as t he Colonial Treasurer shall deem most safe and convenient A n d m a y contain one common s u m or different sums in t he principal moneys A n d shall be signed by t h e Colonial Treasurer t he Audi to r General and by such o ther person or persons as t he Governor in Council shall direct and author ize A n d the names of all other persons so authorized to sign such Bills shall be registered in t he Treasury and publ ished in the N e w South Wales Government Gazette before any Treasury Bills so signed shall be issued. |
4. Al l such Treasury Bills shall be numbered consecutively

5. Al l pr incipal sums to be contained in any such Treasury Bills shall be chargeable upon and paid out of t he Consolidated Revenue of t h e Colony and such Bills shall be made payable on the expirat ion of twelve calendar m o n t h s from the da te thereof.

shall direct A n d shall bear interest payable half-yearly a t a ra te not exceeding five pounds per c e n t u m per a n n u m in respect of t he whole moneys contained there in A n d such interest shall be chargeable upon and paid out of t he Consolidated Revenue of t he Colony and the growing produce thereof.
7. I n case any such Treasury Bill shall be defaced by accident t he Colonial Treasurer m a y cancel t he same and cause a new Bill to be made in t h e Treasury in l ieu thereof and such cancelled Bill shal l be filed in t he Treasury A n d such new Bill shall have t he l ike cur rency and be in all respects subject to t h e same rules methods and con t inuance and bear t he same n u m b e r da te and pr incipal sum and
8. The Colonial Treasurer m a y from t i m e to t ime issue and
apply any s u m or sums of money to arise from any such TreasuryBil ls towards pay ing off a t m a t u r i t y cer ta in Treasury Bills a m o u n t i n g
in t h e whole to t he sum of Three h u n d r e d and for ty- three t housand
two hund red pounds issued unde r t h e au thor i ty of t h e said Treasury Bills A c t of 1870. 9. The Colonial Treasurer may direct all or any of t h e Treasury Bills m a d e and issued under th is A c t to be paid off and redeemed ou t of t he moneys hereinbefore made and declared applicable to such purpose a t such place and in such m a n n e r as shall be deemed mos t convenient and beneficial to t he publ ic service.
10. U p o n proof be ing made on oa th before a J u d g e of t h e Supreme Cour t by any credible person t h a t any Treasury Bill issued under th is A c t and he ld by h i m the n u m b e r and s u m whereof shall be specified by him in his evidence has been lost or accidental ly b u r n t or otherwise destroyed before t h e same shall have been paid off and upon such J u d g e certifying t h a t he is satisfied wi th such proof t h e Colonial
Treasurer m a y cause a new Bill to be m a d e in t h e Treasury bea r ing t h e same n u m b e r date pr incipal sum and ra te of in teres t as t h e Bi l l so lost or destroyed and to be delivered to such person upon his giving sufficient securi ty to t he Colonial Treasurer to indemnify t h e Treasury agains t any double p a y m e n t if t he miss ing Bill shall thereaf ter be
presented for p a y m e n t . 1 1 . Al l Treasury Bills issued unde r this A c t which shall be paid
off and discharged and all defaced Bills as aforesaid shall be cancelled A n d after be ing so cancelled and the accounts thereof h a v i n g been audi ted and allowed and t h e cheques indents and counterfoils delivered back in to t h e Treasury all such Bills toge ther wi th such cheques inden ts and counterfoils shall be b u r n t or otherwise destroyed u n d e r
t h e au tho r i t y of t h e Colonial Treasurer . 12. Eve ry person who shall forge fabricate or counterfei t whol ly
or in pa r t any paper wr i t ing or i n s t r u m e n t p u r p o r t i n g to be a Treasury
Bill u n d e r or according to th i s A c t — o r who shall forge counterfei t a l ter add to obl i tera te or wilfully mu t i l a t e or deface any word le t ter or figure in or upon any such Treasury Bi l l—or who shall fill u p wi th any word le t ter or figure any b l ank space in or upon any such Treasury Bill whe ther issued or no t and whe the r whol ly or par t ly made unde r this A c t — o r who shall u t t e r pass or negot ia te or a t t e m p t to u t t e r pass or negot ia te any such forged fabricated counterfei ted al tered added to obl i terated wilfully mut i l a t ed or defaced or filled u p Bil l as aforesaid
knowing the same to be so shall be gui l ty of felony and shal l be liable
to t h e ex t reme p u n i s h m e n t appl icable by law to t h e cr ime of forgery. 13 . A l l such sums of money as shal l be raised by Treasury Bills to be m a d e out in pur suance of th is A c t shall be carried to and form pa r t of t he Consolidated Revenue of t h e Colony.
14. This A c t shall commence on the day of t he passing thereof and shall be styled and m a y be ci ted as t h e " Treasury Bills A c t of 1 8 7 1 . "
