Travel Agents (Exemption) Order 2005
I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 5(1) of the Travel Agents Act 1987 .23 March 2005

1Short titleThis order may be cited as the Travel Agents (Exemption) Order 2005 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3InterpretationIn this order – Act means the Travel Agents Act 1987 ; reciprocating State or Territory means a State or Territory specified in Schedule 1 . 4Exemption for travel agents in a reciprocating State or Territory (1) Part III of the Act does not apply to a person who is authorised to carry on business as a travel agent under a written law of a reciprocating State or Territory, to the extent that the person – (a) advertises in Tasmania, if the person states in the advertisement – (i) the person’s name; and (ii) the number of any authorisation issued to the person under that law; and (iii) the name of the reciprocating State or Territory in which the authorisation was issued; or (b) provides information to prospective customers in connection with the person’s business as a travel agent. (2) Subclause (1) does not authorise the person to carry on business as a travel agent – (a) if the person is physically present in Tasmania; or (b) through another person who is physically present in Tasmania.
