TRAVEL AGENTS ACT 1986—REGULATION

(Relating to places at which travel agents may carry on business

and to their qualifications)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Travel Agents Act 1986, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 15 April 1994.

Amendments

2. The Travel Agents Regulation 1987 is amended:

(a)

byomittingclause9(a) and byinserting instead the following paragraph:

(a)

that the place complies with the LocalGovernment Act 1993, any other relevant Act and any requirement of, or condition imposed by, the council of the area in which it is situated;

(b)

byomitting clause 9(g) and byinserting instead the following paragraph:

(g)

that the place does not comprise a room (or any part ofa suite) used for the lodging of guests in a hotel or motel.

(c) byomittingthematterunder the heading “QUALIFICATIONS” in Schedule 1 and by inserting instead the following matter: Completion of a travel agent’s course that is accredited by the

Australian Travel Training Review Panel (or any similar national body that succeeds that Panel) at a level specified by the Panel or body.

Completion, at a level specified by the Australian Travel Training Review Panel (or any similar national body that succeeds that Panel), of a travel agent’s course that was accredited by the Panel or body at the time the course was completed.

Any other qualification approved by the Commissioner.

EXPLANATORY NOTE

The objects of this Regulation are:

(a)

toremovethecurrentprohibitiononalicensedtravelagent’scarryingon business in a residence or in a hotel or motel (although there will still be a prohibition on the use of a hotel or motel guestroom for that business); and

(b)

toreplacethecurrentlistofprescribedqualificationsfortravelagents,one of which is required to be held by the person who is in charge of the day-to-day conduct of a travel agency.

The Regulation also updates a reference to the Local Government Act 1919 and

the language used in that Act.
