GLEESON CJ:   The New South Wales Court of Appeal dismissed an application for leave to appeal in respect of a verdict for the defendants in a defamation action by the plaintiff.  The judgment in that action was given on 4 October 1990.

There are no prospects of success in any appeal to this Court.  Special leave is refused with costs, but not the indemnity costs sought by the respondents.

Pursuant to r 41.11.1 we direct the Registrar to draw up, sign and seal an order dismissing with costs this application for special leave.

AT 9.24 AM THE MATTER WAS CONCLUDED
