Proposed protected action ballot by employees of St Albans Management Pty Ltd.

[1] An application has been made, pursuant to s.437 of the Fair Work Act 2009 (the Act), by the Transport Workers’ Union of Australia for a protected action ballot order.

[2] I am satisfied that the statutory requirements for a protected action ballot order have been met.

[3] The respondent seeks a longer period of notice than that provided for by s.414(2)(a) of the Act.

[4] I have decided not to specify a longer notice period in the order.

[5] I will publish reasons for my decision in due course.

[6] An order under s.437 of the Act will issue accordingly.
