Transport (Ticketing) Amendment Regulations 2013

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is—

(a)to amend the Transport (Ticketing) Regulations 2006 to substitute references to the Public Transport Ticketing Body with references to the Public Transport Development Authority following the transfer of responsibility for all public transport ticketing functions to that Authority; and

(b)to make other amendments of a consequential nature.

2Authorising provisions

These Regulations are made under sections 221AA and 230AH of the Transport (Compliance and Miscellaneous) Act 1983.

3Definitions and reference provision

In regulation 5(1) of the Transport (Ticketing) Regulations 2006[1], in the definitions of central computer system and retail agent, for "Public Transport Ticketing Body" substitute "Public Transport Development Authority".

4Defence in relation to travel

For the example at the foot of regulation 12(2) of the Transport (Ticketing) Regulations 2006 substitute

"Example for regulation 12:

An example of an additional action necessary for a ticket that is a myki to be made valid for travel is to have the myki scanned by a smartcard reader and made valid.".

5Defence in relation to entry to a designated area

For the example at the foot of regulation 13(2) of the Transport (Ticketing) Regulations 2006 substitute

"Example for regulation 13:

An example of an additional action necessary for a ticket that is a myki to be made valid for an entry to a designated area is to have the myki scanned by a smartcard reader and made valid.".

6Insufficient time not a defence in certain circumstances

In regulation 14 of the Transport (Ticketing) Regulations 2006—

(a)for "to purchase a ticket" substitute "to carry out a relevant action in relation to a ticket"; and

(b)for "did not purchase a ticket" substitute "did not carry out a relevant action in relation to a ticket"; and

(c)for "to purchase the ticket or carry out those" substitute "to carry out a relevant action in relation to the ticket or carry out those additional".

7Convictions or findings of guilt for certain offences

In regulation 21(1) of the Transport (Ticketing) Regulations 2006, for "9(3), 20(1) or 20(2)" substitute "9(3) or 20(1)".
