Transport (Taxi-Cabs) (Amendment) Regulations

The Governor in Council makes the following Regulations:

1. Objectives
The objectives of these Regulations are—
(a) to empower the Secretary to the Department of Transport to exempt certain holders of driver's certificates from a condition of the certificate; (b) to remove the powers of the Secretary to the Department of Transport to exempt taxi-cabs from requirements relating to the fitting of boot lock release devices and limit the driver duress alarms.
2. Authorising provisions
These Regulations are made under sections 162 and 256 of the Transport Act 1983.

3. Commencement
These Regulations come into operation on 1
October 1996.
4. Amendment of Transport (Taxi-Cabs) Regulations
(1) In regulation 6 of the Transport (Taxi-Cabs) Regulations 19941, after sub-regulation (10) insert—
"(11) The Secretary may exempt the holder of a
driver's certificate from the condition
specified in sub-regulation (2)(a) if satisfiedthat the holder—
(a) holds a probationary driver licence to drive a motor vehicle under the Road Safety Act 1986; and (b) is fit to drive a taxi-cab on account of his or her age, experience or other special circumstances.".
(2) In regulation 13 of the Transport (Taxi-Cabs) Regulations 1994, paragraphs (a) and (b) are repealed.
5. Amendment of Transport (Passenger Vehicles) Regulations
In regulation 6 of the Transport (Passenger
Vehicles) Regulations 19942, after sub-regulation(11) insert—
"(12) The Secretary may exempt the holder of a
driver's certificate from the condition
specified in sub-regulation (2) if satisfiedthat the holder—
(a)
holds a probationary driver licence to drive a motor vehicle under the Road Safety Act 1986; and

(b)
is fit to drive a vehicle on account of his or her age, experience or other special circumstances.".
