Transport (Safety Schemes Compliance and Enforcement) (Infringements) Amendment (Local Ports) Regulations 2025

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Transport (Safety Schemes Compliance and Enforcement) (Infringements) Regulations 2024—

(a)to prescribe certain offences under the Port Management (Local Ports) Regulations 2025 as transport safety infringements; and

(b)to prescribe penalties for those transport safety infringements.

2Authorising provision

These Regulations are made under section 132 of the Transport (Safety Schemes Compliance and Enforcement) Act 2014.

3Commencement

These Regulations come into operation on 22 June 2025.

4Principal Regulations

In these Regulations, the Transport (Safety Schemes Compliance and Enforcement) (Infringements) Regulations 2024[1] are called the Principal Regulations.

5Transport safety infringements

(1)In regulation 6(1) of the Principal Regulations, for "the Table" substitute "Tables 1 or 2".

(2)In regulation 6(2) of the Principal Regulations—

(a)for "the Table" substitute "Table 1 or Column 3 of Table 2";

(b)for "that Table" substitute "those Tables".

(3)In regulation 6(3) of the Principal Regulations, for "the Table" substitute "Table 1".

(4)In the note at the foot of regulation 6 of the Principal Regulations, for "the Table" substitute "Table 1".

6Schedule 2—Transport safety infringements

(1)In Schedule 2 to the Principal Regulations—

(a)for "Offences Against Marine Safety Laws" substitute "Table 1—Offences against Marine Safety and Bus Safety laws";

(b)omit "Offences Against Bus Safety Laws".

(2)In the Table in Schedule 2 to the Principal Regulations—

(a)in Column 2 omit "Port Management (Local Ports) Regulations 2015";

(b)omit items 92 to 121.

(3)After the Table in Schedule 2 to the Principal Regulations insert

Penalty Units

These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the Sentencing Act 1991. The amount of the penalty is to be calculated, in accordance with section 7 of the Monetary Units Act 2004, by multiplying the number of penalty units applicable by the value of a penalty unit.

The value of a penalty unit for the financial year commencing 1 July 2024 is $197.59 and for the financial year commencing 1 July 2025 is $203.51. The amount of the calculated penalty may be rounded to the nearest dollar.

The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
