Transport (Roads and Property) (Amendment)

Regulations 1999

The Lieutenant-Governor as the Governor's Deputy with the
advice of the Executive Council makes the following
Regulations:

1. Objective

The objective of these Regulations is to amend the
Transport (Roads and Property) Regulations

1993—

(a)

to confer on the operators of the Link road certain road and administration powers in respect of that road; and

(b)

to provide for the recovery of the cost of storing and disposing of abandoned vehicles.

2. Authorising provisions

These Regulations are made under sections 56 and
56A of the Transport Act 1983.

3. Principal Regulations

In these Regulations, the Transport (Roads and
Property) Regulations 19931 are called the

Principal Regulations.

4. Amendment of objective

In regulation 3 of the Principal Regulations, after "Corporation" insert "and of the Link corporation within the meaning of the Melbourne City Link Act 1995".

5. Amendment of authorising provisions

In regulation 4 of the Principal Regulations, after

"56" insert ", 56A".

6. Definitions

In regulation 5(1) of the Principal Regulations
insert—

' "freeway" includes that part of the Link road

which, under a declaration made under
section 61(1) of the Melbourne City Link

Act 1995, is to be treated as a freeway;

"Link corporation" has the same meaning as in

the Melbourne City Link Act 1995;'.

7. Removal of abandoned vehicles

(1) In regulation 10(3)(b) of the Principal

Regulations, after "the road" insert "and storing the vehicle until claimed by the owner or sold under regulation 11".

(2) After regulation 10(3) of the Principal Regulations

insert—

"(4) Sub-regulation (3) as amended by regulation

7(1) of the Transport (Roads and Property)
(Amendment) Regulations 1999 only applies
to vehicles removed by the Corporation after
the commencement of those Regulations.".

8. Sale of abandoned vehicles

(1) In regulation 11(4) of the Principal Regulations, for "a sum calculated under regulation 10(3)(b)" substitute "the actual expenses incurred by the

Corporation in removing, storing and selling the vehicle".

(2) After regulation 11(4) of the Principal Regulations

insert—

"(5) Sub-regulation (4) as amended by regulation

8(1) of the Transport (Roads and Property)
(Amendment) Regulations 1999 only applies
to vehicles sold by the Corporation after the

commencement of those Regulations.".

9. Access to freeways

For regulation 12(1) of the Principal Regulations
substitute—

"(1) A person must not enter, cross or leave a

freeway except at a crossing or point of

access provided by—

(a)

in the case of the Link road, the Link corporation;

(b)

in the case of any other freeway, the Roads Corporation—

and subject to any conditions determined by
the Roads Corporation and displayed near
the crossing or point of access.

Penalty: 4 penalty units.".

10. Persons, etc on freeways

In regulation 13(4)(d) of the Principal
Regulations, for sub-paragraph (ii) substitute—

"(ii) used solely for construction or maintenance

purposes under the direct control of—

r. 10 S.R. No. 57/1999

(A) in the case of the Link road, the Link

corporation; or

(B) in the case of any other road, the Roads

Corporation; or".
