An Act to amend the Transport Aet, 1930, in relation to the Road Transport and Traffic Fund and the Road Transport and Traffic Fund Advance Payments Account, and for other purposes. [Assented to, 19th November, 1982.]

Transport (Road Transport and Traffic Fund) Further Amendment.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

This Act may be cited as the “Transport (Road Transport and Traffic Lund) Lurther Amendment Act, 1982”.

1.

Amendment of Act No. 18, 1930.

2. The Transport Act. 1930. is amended in the manner set forth in Schedule 1.

Validation of certain payments.

3.          Any payment made from the Road Transport and Traffic Lund

Advance Payments Account kept under section 202 a of the Transport Act, 1930, to the Road Transport and Traffic Lund kept under section 202 of that Act, being a payment which—

(a) v.'as made before the date of assent to this Act; and (b) but for this Act, could not lawfully have been made,

is hereby validated to the extent that, had this Act been in force when it was

so made, it could lawfully have been made.

(1) Section 202 (.3) —

After section 202 (4). insert; —

(5) Where, at anv time during anv financial year, the amount

standing to the credit of the Road Transport and Traffic Lund

to pay the refunds referred to in section 2 02 a (2) (a), the Commis­ sioner may pay out of the fund, without further appropriation by Parliament than this Act, such amounts as may be necessary to pay those refunds.

(2) (a) Section 202 a (2 ) (a) —

Omit “ 1909, as amended by subsequent Acts; and”, insert instead “1909;”.

(b) Section 202 a (2 ) (a l) —

After section 202 a (2 ) (a), insert:—

( a l ) by paying, from time to time during each financial year, to the credit of the Road Transport and Traffic Fund such amount (not exceeding the amount of that part of the fees paid for drivers’ licenses that is attributable to that year ) as the Commissioner may determine; and

(c) Section 202 a (21 (b) —

After “paragraph (a )”, insert “or ( a l ) ”.
