Transport (Road Passenger Services) Amendment Regulations (No. 2) 2024

Made by the Governor in Executive Council.

1.Citation

These regulations are the Transport (Road Passenger Services) Amendment Regulations (No. 2) 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    regulations 1 and 2 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on the day after that day.

3.Regulations amended

These regulations amend the Transport (Road Passenger Services) Regulations 2020.

4.Regulation 3 amended
  • (1)

    In regulation 3 delete the definition of unit of competency TLIC2040.

  • (2)

    In regulation 3 insert in alphabetical order:

     

AS, followed by a designation, means the Australian Standard having that designation that is published by Standards Australia;

unit of competency, followed by a designation, means the unit of competency having that designation that is published on the National Register (as defined in the National Vocational Education and Training Regulator Act 2011 (Commonwealth) section 3);

  • (3)

    In regulation 3 in the definition of AS/NZS delete “Zealand, as at 1 July 2020;” and insert:

     

Zealand;

5.Regulation 10 amended

In regulation 10(1) delete “72” and insert:

6.Regulation 18 amended

In regulation 18(1)(a):

  • (a)

    in subparagraph (i) delete “AS/NZS 3856.1:1998,” and insert:

  • (b)

    delete subparagraph (ii) and insert:

     
    • (ii)

      AS 3856.2:2021, Hoists and ramps for people with disabilities — Vehicle fitted, Part 2: Fitting requirements;

       
    7.Regulation 30 amended

Delete regulation 30(1) and insert:

  • (1)

    The driver identity document of the driver of an on‑demand rank or hail vehicle must be displayed prominently in the vehicle.

     
8.Regulation 31 amended
  • (1)

    Delete regulation 31(2)(b)(ii) and insert:

     
    • (ii)

      prominently in the vehicle.

       
  • (2)

    Delete regulation 31(4)(b)(ii) and insert:

     
    • (ii)

      prominently in the vehicle.

       
9.Regulation 35 amended

In regulation 35(2) delete “TLIC2040 —” and insert:

TLIC0026 — Provide wheelchair accessible taxi services to passengers with disabilities (Release 1) —

10.Regulation 61 amended
  • (1)

    Delete regulation 61(1)(c) and insert:

     
    • (c)

      a business name used by the provider in connection with the provision of the on‑demand booking service.

       
  • (2)

    Delete regulation 61(2)(b)(iii) and insert:

     
    • (iii)

      a business name used by the provider of the principal booking service in connection with the provision of the principal booking service.

       
11.Regulation 64 amended

In regulation 64(b) delete “any trading name or” and insert:

12.Regulation 76 amended

In regulation 76:

  • (a)

    delete paragraph (a)(iii) and insert:

     
    • (iii)

      a business name used by the provider in connection with the provision of the regular passenger transport service;

       
  • (b)

    delete paragraph (b)(iii) and insert:

     
    • (iii)

      a business name used by the authorised provider in connection with the provision of the authorised regular passenger transport service.

       
    13.Regulation 131 amended
  • (1)

    Delete regulation 131(1)(c) and insert:

     
    • (c)

      the business name used by the provider in connection with the provision of the on‑demand booking service.

       
  • (2)

    In regulation 131(2):

    • (a)

      delete paragraph (a)(ii) and insert:

       
      • (ii)

        the business name used by the provider of the associated booking service in connection with the provision of the associated booking service;

         
    • (b)

      delete paragraph (b)(iii) and insert:

       
      • (iii)

        a business name used by the provider of the principal booking service in connection with the provision of the principal booking service.

         
      14.Regulation 133 amended
  • (1)

    In regulation 133(1) delete “displayed on the fare calculation device must be clearly visible to passengers in the vehicle who wish to view them,” and insert:

     

shown by the fare calculation device must be displayed prominently in the vehicle,

  • (2)

    In regulation 133(5)(a) delete “display” and insert:

15.Regulation 145 amended

In regulation 145(1):

  • (a)

    in paragraph (c) delete “vehicle.” and insert:

  • (2)

    In regulation 145(2) delete “Act,” and insert:

    In disclosing the authorisation status of a passenger transport driver under section 153 of the Act to a recipient who is a member of the public, the CEO may disclose whether the driver holds a passenger transport driver authorisation that is in force.

  • (5)

    The authorisation status of a passenger transport driver must not be disclosed under section 153 of the Act to a recipient who is a member of the public unless the recipient provides the passenger transport driver authorisation number of the driver.

     
16.Regulation 155 amended

In regulation 155(2)(b) delete “call out fee, guaranteed booking fee” and insert:

17.Part 13 Division 4 inserted

At the end of Part 13 insert:

Division 4 — Transitional provision in relation to the Transport (Road Passenger Services) Amendment Regulations (No. 2) 2024

200A. Display of fare schedules

  • (1)

    In this regulation —

approved form means a form approved for the purposes of regulation 118(2)(a);

commencement day means the day on which the Transport (Road Passenger Services) Amendment Regulations (No. 2) 2024 regulation 18 comes into operation;

former Schedule 4 means Schedule 4 as in operation immediately before commencement day.

  • (2)

    A relevant person who ensures that a fare schedule in an approved form that is in force immediately before commencement day is displayed does not commit an offence under regulation 118(1) solely because the fare schedule is in that form and —

    • (a)

      describes the booking fee as a call out fee; or

    • (b)

      states a guaranteed booking fee under former Schedule 4.

  • (3)

    This regulation ceases to have effect at the end of the period of 12 months beginning on commencement day.

     
18.Schedule 4 amended

In Schedule 4 delete:
