Transport Regulations Amendment (Prevention of Collisions in State Waters) Regulations 2025

Made by the Governor in Executive Council.

Part 1 – Preliminary1.Citation

These regulations are the Transport Regulations Amendment (Prevention of Collisions in State Waters) Regulations 2025.

2.Commencement

These regulations come into operation as follows —

• (a)

  Part 1 — on the day on which these regulations are published on the WA legislation website;

• (b)

  the rest of the regulations — on the day after that day.

Part 2 – Navigable Waters Regulations 1958 amended3.Regulations amended

This Part amends the Navigable Waters Regulations 1958.

4.Regulation 13 amended

In regulation 13 delete “Prevention of Collisions at Sea Regulations 1983” and insert:

Prevention of Collisions in State Waters Regulations 1983

Note: The heading to amended regulation 13 is to read:

Prevention of Collisions in State Waters Regulations 1983 apply

5.Regulation 50A amended

In regulation 50A(4) in the definition of freestyle driving delete “Prevention of Collisions at Sea Regulations 1983” and insert:

Prevention of Collisions in State Waters Regulations 1983

6.Regulation 52G amended

In regulation 52G(1) delete “Prevention of Collisions at Sea Regulations 1983.” and insert:

Prevention of Collisions in State Waters Regulations 1983.

Part 3 – Prevention of Collisions at Sea Regulations 1983 amended7.Regulations amended

This Part amends the Prevention of Collisions at Sea Regulations 1983.

8.Regulation 1 amended

In regulation 1 delete “Prevention of Collisions at Sea Regulations 1983.” and insert:

Prevention of Collisions in State Waters Regulations 1983.

9.Regulation 4 amended

In regulation 4 delete the passage that begins with “the area constituted” and continues to the end of the regulation and insert:

State waters.

10.Part A rule 1 amended

Delete Part A rule 1(a) and insert:

• (a)

  These Rules apply to all vessels in State waters.

   

Part 4 – Shipping and Pilotage (Mooring Control Areas) Regulations 1983 amended11.Regulations amended

This Part amends the Shipping and Pilotage (Mooring Control Areas) Regulations 1983.

12.Regulation 16A amended

In regulation 16A(1) and (2) delete “Prevention of Collisions at Sea Regulations 1983” and insert:

Prevention of Collisions in State Waters Regulations 1983

Part 5 – Western Australian Marine (Infringements) Regulations 1985 amended13.Regulations amended

This Part amends the Western Australian Marine (Infringements) Regulations 1985.

14.Schedule 1 amended

In Schedule 1 item 90A delete “Prevention of Collisions at Sea Regulations 1983” and insert:

Prevention of Collisions in State Waters Regulations 1983
