and Refund) Regulations 2022

Made by the Governor in Executive Council.

Part 1 — Preliminary

1.             Citation

These regulations are the Transport Regulations Amendment
(Fee Waiver and Refund) Regulations 2022.

2.             Commencement

These regulations come into operation as follows —

(a) Part 1 — on the day on which these regulations are

published in the Gazette;

(b) the rest of the regulations — on the day after that day.

Part 2 — Road Traffic (Authorisation to Drive)

Regulations 2014 amended

3.             Regulations amended

This Part amends the Road Traffic (Authorisation to Drive)
Regulations 2014.

4.             Regulation 73A inserted

After regulation 73 insert:

73A.	Power to reduce, waive or refund fee payable under r. 73
(1)	The CEO may reduce, waive or refund, in whole or in part, a fee payable by a person, or a class of persons, under regulation 73(1) or (2).

(2)	If the CEO decides to reduce, waive or refund a fee under subregulation (1) in relation to a person, the CEO must give written notice of the decision to the person.
(3)	If the CEO decides to reduce, waive or refund a fee under subregulation (1) in relation to a class of persons, the CEO must publish written notice of the decision on
the Department’s website.

Part 3 — Western Australian Photo Card

5.             Regulations amended

This Part amends the Western Australian Photo Card
Regulations 2014.

6.             Regulation 3 amended

In regulation 3 insert in alphabetical order:

Department’s website means a website maintained by

or on behalf of the Department;

7.             Regulation 7D inserted

After regulation 7C insert:

7D.	Reduction, waiver or refund of fee for replacement photo card
(1)	The CEO may reduce, waive or refund, in whole or in part, the fee payable by a person, or a class of persons, set out in item 2 of the Table to regulation 7.
(2)	If the CEO decides to reduce, waive or refund a fee under subregulation (1) in relation to a person, the CEO must give written notice of the decision to the person.
(3)	If the CEO decides to reduce, waive or refund a fee under subregulation (1) in relation to a class of persons, the CEO must publish written notice of the decision on
the Department’s website.
