Part 1— Preliminary
1. Citation
These regulations are the Transport Regulations Amendment

2. Commencement
These regulations come into operation as follows —
(a)
Part 1 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day. Part 2 — Road Traffic (Authorisation to Drive)
Regulations 2014 amended
3. Regulations amended This Part amends the Road Traffic (Authorisation to Drive)
Regulations 2014.
4. Regulation 73 amended
After regulation 73(3) insert:
(4) A fee is not payable under subregulation (1) or (2) if a
replacement driver's licence document or a
replacement learner's permit document is issued to
replace a document that was lost, damaged or
destroyed as a direct result of an approved emergency.(5) For the purposes of subregulation (4) each of the
following is an approved emergency —
(a) an emergency situation declared under the Emergency Management Act 2005 section 50;
(b)
a state of emergency declared under section 56 of that Act;
(c)
a hazard (as defined in section 3 of that Act) that occurs within the State and is approved by the CEO for the purposes of this paragraph.
Part 3 — Western Australian Photo Card Regulations 2014 amended
5. Regulations amended This Part amends the Western Australian Photo Card
Regulations 2014.
6. Regulation 7C inserted
After regulation 7B insert:
7C. No fee payable for replacement photo cards in
certain situations
(1) The fee set out in item 2 of the Table to regulation 7 is
not payable if a replacement photo card is issued to

destroyed as a direct result of an approved emergency.
(2) For the purposes of subregulation (1) each of the
following is an approved emergency -
(a)
an emergency situation declared under the Emergency Management Act 2005 section 50;
(b)
a state of emergency declared under section 56 of that Act;
(c)
a hazard (as defined in section 3 of that Act) that occurs within the State and is approved by the CEO for the purposes of this paragraph.
