Act No. 76, 1988

An Act to amend the Transport Act 1930 in relation to the cancellation of licences and vehicle registrations as a consequence of a failure to pay a penalty or other amount in respect of certain offences, and for other purposes. [Assented to 23 November 1988]

Transport (Penalty Defaults) Amendment 19SS

The legislature of New South Wales enacts;

Short title

1. This Act may be cited as the Transport (Penalty Defaults)

Amendment Act 1988.

Commencement

2.     This Act commences on the date of assent.

Amendment of Transport Act 1930 No. 18

3. The Transport Act 1930 is amended as set out in Schedule 1.

SCHEDULE 1—AMENDMENTS

(Sec. 3)

Section 265 (Minor traffic offences)—

(1) Section 265 (3) (a) (i)—

Omit “penalty”, insert instead “fine, penalty, costs or other amount of money payable”.

(2) Section 265 (3) (c)—

Omit “penalty and charges” , insert instead “ fine, penalty, costs or other amount of money, and of any such charges” .

(3) Section 265 (5)—

After section 265 (4), insert;

(5) Regulations made for the purposes of subsection (3) may be made so as to apply in relation to fines, penalties, costs or other amounts of money imposed or ordered to be paid before or after the date on which the regulations take effect.
