Transport (Passenger Vehicles) (Amendment) Regulations 2007
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Transport (Passenger Vehicles) Regulations 2005 to make further provision for the process for accrediting drivers of commercial passenger vehicles (other than taxi-cabs) and vehicles used for the operation of a private bus service.
2Authorising provisions
These Regulations are made under sections 162, 169Z and 256 of the Transport Act 1983.
3Commencement
These Regulations come into operation on 1 July 2007.
4Principal Regulations
In these Regulations, the Transport (Passenger Vehicles) Regulations 2005[1] are called the Principal Regulations.
5Definitions
In regulation 4 of the Principal Regulations—
(a)at the foot of the definition of accreditation insert—
"Note
This accreditation differs from driver accreditation as defined in section 86(1) of the Act.";
(b)for the definition of private omnibus substitute—
"private bus means a motor vehicle that is used for operating a private bus service;";
(c)the definitions of commercial passenger vehicle, driver's certificate and public commercial passenger vehicle are revoked;
(d)in the definition of licence omit "or a private omnibus";
(e)in the definition of vehicle, for "private omnibus" substitute "private bus".
6Heading for Part 2 substituted
For the heading to Part 2 of the Principal Regulations substitute—
"PART 2—DRIVER ACCREDITATION, LICENCES AND RECORD KEEPING REQUIREMENTS".
7New Division 1 of Part 2
For Division 1 of Part 2 of the Principal Regulations substitute—
"Division 1—Driver Accreditation
6Prescribed class of person to give medical certificate
For the purposes of section 167(2)(a) of the Act, a prescribed class of person is a registered medical practitioner within the meaning of the Health Professions Registration Act 2005.
7Test of acuteness of vision
For the purposes of section 167(2)(b) of the Act, the prescribed vision acuteness test is the test set out in Schedule 1.".
8Substitution of references to private omnibus
(1)In regulations 33(2) and 72(1), clauses 20, 21, 22 and 24 of Schedule 2 and the table to Schedule 3 of the Principal Regulations, for "private omnibus" (wherever occurring) substitute "private bus".
(2)In the heading to Part 3 of Schedule 2 and in the table to Schedule 3 of the Principal Regulations, for "private omnibuses" (wherever occurring) substitute "private buses".
9Substitution of references to Secretary
(1)In regulations 16, 17, 18, 19, 20(3), 21, 22, 23, 42, 43(2), 47(1)(c), 49(a) and 71(2) and clauses 13, 23 and 25 of Schedule 2 of the Principal Regulations, for "Secretary" (wherever occurring) substitute "Director".
(2)In regulation 5(c) of the Principal Regulations, for "a bus company or the Secretary" substitute "a bus company, the Secretary or the Director".
(3)In regulation 30 of the Principal Regulations, for "the Roads Corporation or the Secretary" (wherever occurring) substitute "the Roads Corporation, the Secretary or the Director".
10Amendment of Schedule 1—vision acuteness test
(1)In Schedule 1 to the Principal Regulations for "Regulation 8" substitute "Regulation 7".
(2)In Schedule 1 to the Principal Regulations after clause 4, insert—
"5The test for acuteness of vision may be conducted by—
(a)a person who is registered as an optometrist under the Health Professions Registration Act 2005; or
(b)a registered medical practitioner within the meaning of the Health Professions Registration Act 2005.
6The person who conducts the test may issue a certificate to the applicant which—
(a)contains the results of the test; and
(b)states whether or not the applicant has passed the test.".
