Transport Act 1983

Transport (Passenger Vehicles) (Amendment) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to clarify the intended extent of exemptions from the licensing requirements of Division 5 of Part VI of the Transport Act 1983.

2.Authorising provision

These Regulations are made under section 162 of the Transport Act 1983.

3.New regulation 74 substituted

For regulation 74 of the Transport (Passenger Vehicles) Regulations 2005[1] substitute

"74.Exemption from licensing requirement

A commercial passenger vehicle that—

(a)is not a taxi-cab within the meaning of section 86(1) of the Act; and

(b)is operated by an accredited person within the meaning of the Public Transport Competition Act 1995 to provide services in accordance with the conditions of the person's accreditation under Part 2 of that Act—

is exempt from section 139(1) of the Act.".
