Part 1    Preliminary

1   Short title

This regulation may be cited as the Transport Operations (Road Use Management—Vehicle Registration) and Other Legislation Amendment Regulation 2019.

2   Commencement

Parts 2 and 3, other than section 14, commence on 30 November 2019.

Part 2    Amendment of Motor Accident Insurance Regulation 2018

3   Regulation amended

This part amends the Motor Accident Insurance Regulation 2018.

4   Omission of s 7 (Additional amount for insurer’s premium if registration period more or less than 1 year—Act, s 13)

33   Industry deed

To avoid any doubt, it is declared that the industry deed in force immediately before the commencement of the Transport Operations (Road Use Management—Vehicle Registration) and Other Legislation Amendment Regulation 2019, part 2 continues in force according to its terms.

6   Amendment of sch 4, s 16 (Transport administration’s obligation to provide information for licensed insurers)

(1)Section 16—
insert—
(1A)Transport administration must also give a licensed insurer for a registered motor vehicle, with a registration period of 1 month, access to the email address of the registered operator of the vehicle.
(2)Section 16(2), after ‘The information’—
insert—

mentioned in subsection (1)

(3)Section 16(1A) and (2)—
renumber as section 16(2) and (3).

7   Amendment of sch 4, s 17 (Notice to accompany registration renewal notice)

Section 17(1)—
omit, insert—
(1)Transport administration must send, with each notice for the renewal of registration of a motor vehicle, a list of licensed insurers in a form approved by the commission.

Part 3    Amendment of Transport Operations (Road Use Management—Vehicle Registration) Regulation 2010

8   Regulation amended

This part amends the Transport Operations (Road Use Management—Vehicle Registration) Regulation 2010.

9   Amendment of s 22 (Registration term)

(1)Section 22(c)—
omit, insert—
(c)3 months, if—
(i)the vehicle is a category 2 vehicle; or
(ii)the vehicle is used to provide a taxi service or a booked hire service within the meaning of the Transport Operations (Passenger Transport) Act 1994; or
(iii)the applicant agrees to the matters mentioned in paragraph (d)(i) and (ii);
(ca)1 month, if—
(i)the applicant agrees to pay the registration-related amount and any surcharge payable for the renewal of the registration of the vehicle under a direct debit arrangement; and
(ii)the applicant agrees to receive all communication in relation to the registration and renewal of the registration of the vehicle electronically;
(2)Section 22(d), ‘another term’—
omit, insert—

any term, including a term mentioned in paragraph (c) or (d),

(3)Section 22(ca) and (d)—
renumber as section 22(d) and (e).

10   Amendment of s 44 (When surcharge is payable for renewal)

Section 44(1)(b)—
omit, insert—
(b)the amount paid by the applicant for the purpose of the registration-related amount for the renewal is more than $1 below what the registration-related amount would be if the relevant registration fee payable under section 43(1A)(a) for the renewal were for 1 year’s registration.

143   Fees

(1)The amendment of schedule 3, part 3, made by the amending regulation, applies in relation to—
(a)applications made after the commencement for the registration, or renewal of the registration, of a vehicle; and
(b)payments made after the commencement for the renewal of the registration of a vehicle after the expiry date.
(2)The amendment of section 120, made by the amending regulation, applies in relation to applications made after the commencement for the registration, or renewal of the registration, of a vehicle.
(3)In this section—
amending regulation means the Transport Operations (Road Use Management—Vehicle Registration) and Other Legislation Amendment Regulation 2019.
