Transport Operations (Road Use Management—Vehicle Registration) Amendment Regulation (No. 1) 2010 [s 1] 1 Short title This regulation may be cited as the Transport Operations (Road Use Management—Vehicle Registration) Amendment Regulation (No. 1) 2010 . 2 Regulation amended This regulation amends the Transport Operations (Road UseManagement—Vehicle Registration) Regulation 1999. 3 Amendment of s 68AA (Release of information to toll road operator, local government tollway operator and other persons) (1) Section 68AA, heading, ‘toll road operator, local government tollway operator and other persons’— omit, insert — ‘ relevant tolling entities and other persons ’. (2) Section 68AA— insert— ‘(1A) Without limiting subsection (1), the chief executive may, under an arrangement in writing entered into between the chief executive and a local government, give an extract from a relevant register of information about a vehicle to— (a) the local government; or (b) a person acting for the local government; for the purpose of the local government enforcing tolling offences committed in relation to a local government tollway in the local government area.’. (3) Section 68AA(2), ‘The arrangement’— omit, insert— ‘An arrangement under subsection (1) or (1A)’. (4) Section 68AA(3), ‘toll road operator or local government tollway operator’— Page 2 2010 SL No. 3

(5) Section 68AA(3), after ‘subsection (1)’— insert— ‘or (1A)’. (6) Section 68AA(4), ‘toll road operator or local government tollway operator’— omit, insert — ‘relevant tolling entity’. (7) Section 68AA(4) and (5), after ‘subsection (1)’— insert— ‘or (1A)’. (8) Section 68AA(6)— insert — ‘ local government tollway see the TransportInfrastructureAct 1994 , section 105GA(5). relevant register means— (a) the register; or (b) an interstate register that is available to the chief executive through NEVDIS. relevant tolling entity means any of the following— (a) a toll road operator; (b) a local government tollway operator; (c) a local government with which the chief executive has entered into an arrangement under subsection (1A). tolling offence means an offence against the TransportInfrastructureAct1994 , section 105ZH(3), 105ZJ(4) or 105ZK(3).’. 2010 SL No. 3 Page 3
