Transport Operations (Passenger Transport) Amendment Regulation (No. 2) 2011 [s 1] 1 Short title This regulation may be cited as the Transport Operations (Passenger Transport) Amendment Regulation (No. 2) 2011 . 2 Regulation amended This regulation amends the Transport Operations (Passenger Transport) Regulation 2005 . 3 Insertion of new pt 10A After section 134— insert— ‘Part 10A Authorised person for GCRT ‘134A Appointment ‘For section 111(2)(d) of the Act, the following persons are prescribed to be an authorised person for the GCRT for relevant transport legislation— (a) an employee of a light rail manager for the GCRT; (b) an employee of a light rail operator for the GCRT. ‘134B Powers ‘(1) For section 114(2) of the Act, the powers of an authorised person for the GCRT given under relevant transport legislation are limited to the powers given under the following provisions of the Act— (a) section 127; (b) section 143ADA; (c) section 143ADB; (d) section 143AG; (e) section 143AH; Page 2 2011 SL No. 187

Transport Operations (Passenger Transport) Amendment Regulation (No. 2) 2011 [s 4] (f) section 143AHA(1); (g) section 143AHB(1) and (3). ‘(2) However, the powers given under section 127 of the Act are limited to being exercised for serving an infringement notice against— (a) the following provisions of the Act— (i) section 143AC; (ii) section 143ADA: (iii) section 143ADB; (iv) section 143AE; (v) section 143AF; (vi) section 143AK; or (b) the following provisions of this regulation— (i) section 128; (ii) section 129(1). ‘(3) Also, the power given under section 143AHA(1) of the Act is limited to being exercised for giving a direction under the section for an offence against the following relevant provisions mentioned in the section— (a) section 143AC of the Act; (b) section 143AE of the Act; (c) section 143AF of the Act; (d) section 377 of the Transport Infrastructure Act 1994 . ‘(4) In addition, the powers are limited to being exercised only for the GCRT.’. 4 Insertion of new sch 7A After schedule 7— insert— 2011 SL No. 187 Page 3

Transport Operations (Passenger Transport) Amendment Regulation (No. 2) 2011 [s 5] 5 Amendment of sch 11 (Dictionary) Schedule 11— insert— ‘ GCRT means— (a) the light rail, shown on the map depicted in schedule 7A, known as the Gold Coast Rapid Transit; and (b) any other public transport infrastructure operated by, or under the control of, a light rail manager, or a light rail operator, for the Gold Coast Rapid Transit.’.
