s1 2 s4 Transport Operations (Passenger Transport) No. 73, 1999 Amendment (No. 1) ˙ Short title 1. This regulation may be cited as the Transport Operations (Passenger Transport) Amendment Regulation (No. 1) 1999 . ˙ Commencement 2. This regulation commences on 1 May 1999. ˙ Regulation amended 3. This regulation amends the TransportOperations(PassengerTransport) Regulation 1994 . ˙ Replacement of s 15 (Exemption from scope of operator accreditation and driver authorisation—Act, ss 13(2)(c) and 25(2)(c)) 4. Section 15— omit, insert— ˙ Public passenger services to which the Act, s 12 does not apply 15.(1) Section 12 1 of the Act does not apply to ferry services. (2) Section 12 of the Actdoes not apply to a community transport service or courtesy transport service if— (a) no more than 2 vehicles are available, at any time, to provide the service, and each of the vehicles may be driven under a class C driver’s licence under the Traffic Act 1949 ; or (b) the service is not available to the general community. Examples of services available to the general community— 1. Membership of a bowls club is open to the general community. The club provides a courtesy transport service but only to club members. The service is available to the general community. 2. A community transport service is available to all women living within 10 km of a refuge to take them there. s5 3 s5 Transport Operations (Passenger Transport) No. 73, 1999 Amendment (No. 1) ˙ Requirement for driver authorisation until 31 July 1999—Act, s 25(2)(c) 15A.(1) A community transport service, courtesy transport service and ferry service are exempted from the public passenger services for which driver authorisation is required. (2) This section expires on 31 July 1999. ˙ Requirement for driver authorisation after 31 July 1999—public passenger services to which the Act, s 24 does not apply 15B.(1) After 31 July 1999, 2 section 24 of the Act does not apply to a community transport service or courtesy transport service if— (a) no more than 2 vehicles are available, at any time, to provide the service, and each of the vehicles may be driven under a class C driver’s licence under the Traffic Act 1949 ; or (b) the service is not available to the general community. 3 (2) After 31 July 1999, section 24 of the Act does not apply to ferry services.’. ˙ Amendment of sch 8 (Annual fees) 5. Schedule 8, item 3— omit, insert— 3. Operator accreditation to provide— (a) 1 or more scheduled passenger services, other than accreditation under which only a restricted school service may be operated . . . . . . . . . . . . . . . . . . . . . . . (b) a community transport service . . . . . . . . . . . . . . . . . 102.00 102.00 2 On 1 August 1999, the Act, sections 24 (What is driver authorisation ) and 25 (Scope of driver authorisation) were replaced by a new section 24 (What is driver authorisation), which now covers excluding services, by regulation, from the requirement for driver authorisation. 3 For examples of services available to the general community, see section 15(2).
