This regulation may be cited as the Transport Operations (Marine Safety) (Motor Boat and Motor Vessel) Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the Queensland Marine (Motor Boat and Motor Vessel) Regulation 1975 . ˙ Replacement of pt 1, s 1 (Short title) 3. Part 1, section 1— omit, insert— ˙ ‘ Short title ‘ 1. This regulation may be cited as the Transport Operations (Marine Safety) (Motor Boat and Motor Vessel) Regulation 1975 .’. ˙ Amendment of pt 1, s 2 (Definitions) 4. Part 1, section 2, definition “smooth water limits” — omit, insert— ‘ “partially smooth water limits” means waters (other than waters within smooth water limits) within boundaries described in schedule 6, part A. “smooth water limits” means— (a) waters of waterways; or (b) waters within breakwaters or revetments; or (c) within 0.5 n mile 1 of— (i) a shore within waters described in schedule 6, part A; or 1 ‘n mile’ is the symbol for ‘international nautical mile’.

s5 3 s6 Transport Operations (Marine Safety) (Motor No. 271, 1995 Boat and Motor Vessel) Amendment (No. 1) (ii) a shore forming part of a boundary for waters described in schedule 6, part A; or (d) waters described in schedule 6, part B. “waterway” means a river, creek, stream, canal, lake or inlet.’. ˙ Insertion of new pt 1, s 2A 5. Part 1, after section 2— insert— ˙ ‘ Boundaries ‘ 2A. In this regulation— (a) boundaries along a shore follow the waterline; and (b) other boundaries run in a straight line; and (c) a coastal shore that is interrupted by the mouth of a waterway is taken to continue in a straight line across the mouth between the seaward extremities of the banks of the waterway; and (d) a reference to a tip of a cape, island, or other geographical feature is a reference to the tip on the shore at the water line. Example of paragraph (d) — If a boundary point is described as the southern tip of an island, the point is at the island’s southern tip at the waterline. ’. ˙ Amendment of sch 4 (Speed limits) 6.(1) Schedule 4, heading— omit, insert— ‘ SPEED LIMITS FOR SPEEDBOATS NOT OVER 6.1 M LONG part 5, section 9(b)’.
