s1 2 s5 Transport Operations (Marine Safety—Commercial and Fishing Ships Miscellaneous Equipment) Interim No. 389, 1995 ˙ Short title 1. This standard may be cited as the Transport Operations (Marine Safety—Commercial and Fishing Ships Miscellaneous Equipment) Interim Standard 1995 . ˙ Commencement 2. This standard commences on 1 January 1996. ˙ Who standard applies to 3. This standard applies to the owner or masters of a commercial and fishing ship that is required to be registered under section 56 of the Act. 1 ˙ Purpose of standard 4. This standard is a guide to how to satisfy the general safety obligations under part 4 of the Act. 2 ˙ Miscellaneous equipment 5.(1) A commercial or fishing ship should be equipped in accordance with the Uniform Shipping Laws Code, sections 12, 13 and 18. 3 (2) Alternatively, a commercial or fishing ship should be equipped with equipment to— (a) safely navigate the ship in expected weather conditions; and 1 Section 56 (Regulation may require registration of ship) The Transport Operations (Marine Safety) Regulation 1995 defines what commercial and fishing ships are, and requires certain commercial and fishing ships to be registered. 2 Part 4 of the Act (General safety obligations and standards) 3 Section 12 (Radio equipment) Section 13 (Miscellaneous equipment) Section 18 (Hire and drive vessels)
s6 3 s6 Transport Operations (Marine Safety—Commercial and Fishing Ships Miscellaneous Equipment) Interim No. 389, 1995 (b) safely secure the ship in expected weather conditions, should it be disabled and afloat; and (c) enable the ship to communicate with another ship, or a shore based radio station, in expected weather conditions; and (d) give safety, first aid and reasonable comfort to anyone on board the ship; and (e) allow anyone unhindered access to and from the ship, including equipment to ensure a person does not accidentally fall off the ship; and (f) secure the ship against movement caused by the weather and, in particular, water surges to enable— (i) someone to embark or disembark safely; or (ii) cargo to be transferred to or from the ship safely; and (g) indicate weather changes within the ship’s operational area. Example of paragraph (e)— A gangway with handrails. (3) The equipment mentioned in this section should be in good working order. (4) In this section— “expected weather conditions” , for a ship, means all expected weather conditions within the area in which it is intended the ship will operate. “Uniform Shipping Laws Code” means the Code within the meaning of the Transport Operations (Marine Safety) Regulation 1995 . ˙ Expiry 6. This standard expires 6 months after its commencement.
