s1 2 s5 Transport Operations (Marine Safety) Amendment (No. 3) No. 443, 1997 ˙ Short title 1. This regulation may be cited as the Transport Operations (Marine Safety) Amendment Regulation (No. 3) 1997 . ˙ Commencement 2. This regulation commences on 1 January 1998. ˙ Regulation amended 3. This regulation amends the TransportOperations(MarineSafety)Regulation 1995 . ˙ Amendment of s 168 (Harbour master may carry out direction) 4. Section 168(1) and (2)(a), ‘or 167’— omit, insert— ‘, 167, 176 or 177’. ˙ Insertion of new s 169A 5. Part 9, division 5— insert— ˙ Buoy mooring category areas 169A.(1) The chief executive may, by gazette notice, define areas of Queensland waters as category areas for buoy moorings. (2) The chief executive may define an area as— (a) a category 1 area; or (b) a category 2 area. (3) An area that is not defined as a category 1 or 2 area is a category 3 area. (4) The chief executive may, by written agreement with a person (a “mooring manager” ), vest in the person the management and control of

The authority to charge fees for the use of a buoy mooring. 2. The authority to set conditions on the placement of a buoy mooring. 3. The authority to set conditions on the use of a buoy mooring. ’. ˙ Amendment of s 170 (Issue of buoy mooring authorities) 6.(1) Section 170(1)— omit, insert— 170.(1) The chief executive may issue a buoy mooring authority for— (a) a category 2 area; or (b) a category 3 area.’. (2) Section 170(2)(a), after ‘only a’— insert— ‘particular’. (3) Section 170— insert— (4) However, the assessment component of the application fee for the authority is not payable by a person who, before the commencement of this regulation, established a buoy mooring in accordance with— (a) the Queensland Marine Act 1958 ; or (b) this Act.’. ˙ Amendment of s 171 (Limitations on issue of buoy mooring authorities) 7. Section 171, before ‘interfere with’— insert— ‘significantly’.

Section 174— omit, insert— ˙ Unlawful use of buoy mooring 174.(1) A person must not moor a ship to a restricted buoy mooring unless the ship is the ship stated in the relevant authority. Maximum penalty—50 penalty units. (2) A person must not moor a ship to an unrestricted buoy mooring unless the person has the authority holder’s consent. Maximum penalty—50 penalty units. (3) In this section— “restricted buoy mooring” means a buoy mooring to which a restricted buoy mooring authority relates. “unrestricted buoy mooring” means a buoy mooring to which an unrestricted buoy mooring authority relates.’. ˙ Amendment of s 175 (Notice of establishment of buoy mooring) 9.(1) Section 175, ‘, within 14 days of establishing it, give written notice containing the details mentioned in subsection (2)’— omit, insert— ‘give written notice, containing the details required by the chief executive when issuing the authority,’. (2) Section 175(2), ‘notice must include the following details’— omit, insert— ‘details required by the chief executive may include the following’. (3) Section 175— insert— (3) The notice must be given within 14 days of establishing the buoy mooring.
s 10 5 s 10 Transport Operations (Marine Safety) Amendment (No. 3) No. 443, 1997 (4) This section does not apply to a person who, before the commencement of this regulation, established a buoy mooring in accordance with— (a) the repealed Queensland Marine Act 1958; or (b) this Act.’. ˙ Amendment of s 176 (Removal of buoy mooring on expiry or cancellation of authority) 10.(1) Section 176, heading, ‘ or cancellation ’— omit, insert— , cancellation or surrender ’. (2) Section 176(1), after ‘been cancelled’— insert— ‘or surrendered’. (3) Section 176(2)(a), after ‘has expired’— insert— ‘or been surrendered’. (4) Section 176(2)(b), after ‘buoy mooring’ insert— ‘authority’. (5) Section 176— insert— (3) If the holder fails to remove the buoy mooring within the time stated in subsection (2), the harbour master may direct the holder to remove the buoy mooring. (4) The holder must comply with the direction unless the holder has a reasonable excuse. Maximum penalty—50 penalty units.’.
s 11 6 s 13 Transport Operations (Marine Safety) Amendment (No. 3) No. 443, 1997 ˙ Amendment of s 177 (Unauthorised buoy mooring) 11. Section 177(1)— omit, insert— 177.(1) A person must not establish a buoy mooring— (a) in a category 1 area except with the consent of the mooring manager for the area; or (b) in a category 2 or 3 area unless the chief executive has issued a buoy mooring authority for it under section 170. 1 Maximum penalty—50 penalty units. (1A) If a person establishes a buoy mooring in contravention of subsection (1), a harbour master may direct the person to remove the buoy mooring. (1B) The holder must comply with the direction unless the holder has a reasonable excuse. Maximum penalty—50 penalty units.’. ˙ Amendment of s 197 (Interim power of chief executive to increase quantity of dangerous goods handled in pilotage area) 12. Section 197(9), after ‘2 years’— insert— ‘and 6 months’. ˙ Amendment of sch 7 (Fees) 13.(1) Schedule 7, section 20— omit, insert— Buoy moorings 20.(1) This sections sets the fees for buoy moorings. 1 Section 170 (Issue of buoy mooring authorities)
s 13 7 s 13 Transport Operations (Marine Safety) Amendment (No. 3) No. 443, 1997 (2) The application fee is the total of the assessment and occupation components. (3) The assessment component is $50.00. (4) The occupation component is— (a) for a mooring for restricted use— (i) in a category 2 area—$50.00; or (ii) in a category 3 area—$30.00; or (b) for a mooring for unrestricted use— (i) in a category 2 area—$100.00; or (ii) in a category 3 area—$50.00; or (5) The renewal fee is— (a) for a mooring for restricted use— (i) in a category 2 area—$50.00; or (ii) in a category 3 area—$30.00; or (b) for a mooring for unrestricted use— (i) in a category 2 area—$100.00; or (ii) in a category 3 area—$50.00.’. (2) Schedule 7, section 21(2)— omit, insert— (2) The application and renewal fees for the authority, for each mooring after the first 5 moorings, are— (a) in a category 2 area—$40.00; or (b) in a category 3 area—$30.00.’.
