Part 1 Transport Legislation (Fees) Amendment Regulation (No. 1) 2014 Part 1 Preliminary [s 1] Preliminary 1 Short title This regulation may be cited as the Transport Legislation (Fees) Amendment Regulation (No. 1) 2014 . 2 Commencement This regulation commences on 1 July 2014. Part 2 Amendment of Adult Proof of Age Card Regulation 2010 3 Regulation amended This part amends the AdultProofofAgeCardRegulation 2010. 4 Amendment of s 3 (Fees) Section 3, ‘schedule’— omit, insert schedule 1 5 Numbering and replacement of schedule (Fees) (1) Schedule— number as schedule 1. (3) Despite subsection (2)(b), if the general manager has given a written quotation for the design examination fee and the applicant has accepted the quotation, the design examination fee is the lesser of the following— (a) the quoted fee; (b) the fee that would otherwise be payable under subsection (2)(b) for the time taken to examine the design. 11 Certificate of survey (1) This section sets the fees for a certificate of survey under section 70. (2) The fees are as follows— (a) application fee for the issue of a certificate of survey and examining the documents required to be given with the application, whether or not an inspection of the ship is necessary—$353.40; (b) a fee for inspecting the ship, if an inspection of the ship is necessary, consisting of— (i) $119.30 for each hour of inspection time (excluding travelling time), to the nearest 15 minutes; and 2014 SL No. 61 Page 29

(2) The fees are as follows— (a) for a master class 3 or skipper grade 1—$250.40; (b) for a master class 4, mate class 4 or skipper grade 2—$250.40; (c) for a master class 5 or skipper grade 3—$177.70; (d) for a coxswain—$80.80; (e) for an engineer class 3—$315.00; (f) for a marine engine driver grade 1—$201.90; (g) for a marine engine driver grade 2—$148.65; (h) for a marine engine driver grade 3—$148.65. (2) The fee is the total of the following— (a) $460.05; (b) the additional application fee payable under subsection (3). 2014 SL No. 61 Transport Legislation (Fees) Amendment Regulation (No. 1) 2014 Part 17 Amendment of Transport (Rail Safety) Regulation 2010 [s 41] (a) if the total amount of the person’s estimated rail revenue for the financial year is not more than $250000—nil; (b) if the total amount of the person’s estimated rail revenue for the financial year is more than $250000 but not more than $500000— (i) for an accreditation for only tourist and heritage railway operations—$6464.25; or (ii) for another accreditation—$7757.10; (c) if the total amount of the person’s estimated rail revenue for the financial year is more than $500000— (i) for an accreditation for only tourist and heritage railway operations— (A) $74.25 for each estimated kilometre of railway track for which the person is accredited as a rail infrastructure manager for the financial year; and (B) 8.9c for each estimated kilometre of railway track to be used for transporting passengers or freight under the person’s accreditation as a rolling stock operator for the financial year; or (ii) for another accreditation— (A) $89.00 for each estimated kilometre of railway track for which the person is accredited as a rail infrastructure manager for the financial year; and (B) 10.9c for each estimated kilometre of railway track to be used for transporting passengers Page 69

Examples of kilometres of railway tracks used for transporting passengers or freight 1 If a train uses 300km of railway tracks to transport passengers or freight from point A to point B, and then makes a return journey to point A without passengers or freight, the number of kilometres of railway tracks used to transport the passengers or freight is 2 x 300km (being 600km). 2 If the train mentioned in example 1 makes 30 return journeys between point A and point B each day of a financial year, the number of kilometres of railway tracks used to transport passengers or freight for the financial year is 2 x 300km x 30 x 365 (being 6570000km).
