Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 9 Amendment of Transport Operations (Marine Safety) Regulation 2004 [s 18] ‘6 Exemption from payment of registration fees of particular commercial ship ‘(1) A ship owned by any of the following and used for rescue purposes is exempt from registration fees— (a) the emergency services department; (b) a volunteer marine rescue association or a surf lifesaving association accredited by that department. ‘(2) A ship used exclusively in a marine education course that forms part of an educational program provided at a primary school or secondary school is exempt from registration fees. ‘7 Registration of fishing ship ‘(1) This section sets the fee for registration under section 62, or renewal of registration under section 157, of a fishing ship. ‘(2) The fee consists of the following amount for compliance monitoring— (a) for a ship more than 10m but not more than 15m—$153.45; (b) for a ship more than 15m but not more than 20m—$418.50; (c) for a ship more than 20m but not more than 25m—$516.20; (d) for a ship more than 25m but not more than 35m—$648.65; (e) for a ship more than 35m but not more than 50m—$802.15; (f) for a ship more than 50m but not more than 75m—$864.85; (g) for a ship more than 75m but not more than 100m—$990.55; (h) for a ship more than 100m—$1234.60. 2009 SL No. 64 Page 23
Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 9 Amendment of Transport Operations (Marine Safety) Regulation 2004 [s 18] ‘8 Other registration fees ‘(1) This section sets the fees for other aspects relating to the registration of ships. ‘(2) The fees are as follows— (a) for an application, under section 173, for transfer of registration of a recreational ship—$21.05; (b) for an application, under section 171, for a replacement certificate of registration for a commercial ship or fishing ship—$46.00; (c) administration fee payable for renewal of registration of a recreational ship if paid after the expiry date—$11.95; (d) for an extract from a register under section 72(5) or 73(5) from information in the register— (i) when the application is made—$13.90; or (ii) on another day, if a search of departmental records is not required—$22.25. ‘(3) A fee is not payable under subsection (2)(a) if the ship is being transferred to a person whose business is the sale of new or used ships. ‘9 Restricted use flag ‘(1) This section sets the fees in relation to restricted use flags for ships. ‘(2) The fees are as follows— (a) for a consent to the use of an initial flag, other than a flag mentioned in paragraph (c)—$202.35; (b) for a consent to the use of a second or subsequent flag—$82.25; (c) for a consent to the use of a flag for 1 month or less— (i) for a ship 50m or less—$72.55; or (ii) for a ship more than 50m but not more than 80m—$154.95; or Page 24 2009 SL No. 64
Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 9 Amendment of Transport Operations (Marine Safety) Regulation 2004 [s 18] (iii) for a ship more than 80m but not more than 150m—$328.70; or (iv) for a ship more than 150m but not more than 200m—$516.50; or (v) for a ship more than 200m—$704.30; (d) for a replacement flag—$43.20. ‘10 Design approval certificate ‘(1) This section sets the fees for issuing a design approval certificate. ‘(2) The fees are as follows— (a) application fee for the issue of the certificate and, if requested by the applicant, the giving of a quotation for the design examination fee—$115.30; (b) design examination fee— (i) if an appropriately accredited ship designer has issued a certificate of compliance for the design and the certificate, or a copy of it, is given to the general manager with the application—$103.00 for each hour of examination time, to the nearest 15 minutes; or (ii) otherwise—$137.40 for each hour of examination time, to the nearest 15 minutes. ‘(3) Despite subsection (2)(b), if the general manager has given a written quotation for the design examination fee and the applicant has accepted the quotation, the design examination fee is the lesser of the following— (a) the quoted fee; (b) the fee that would otherwise be payable under subsection (2)(b) for the time taken to examine the design. 2009 SL No. 64 Page 25
Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 9 Amendment of Transport Operations (Marine Safety) Regulation 2004 [s 18] ‘11 Certificate of survey ‘(1) This section sets the fees for a certificate of survey under section 70. ‘(2) The fees are as follows— (a) application fee for the issue of a certificate of survey and examining the documents required to be given with the application, whether or not an inspection of the ship is necessary—$305.20; (b) a fee for inspecting the ship, if an inspection of the ship is necessary, consisting of— (i) $103.00 for each hour of inspection time (excluding travelling time), to the nearest 15 minutes; and (ii) the reasonable travelling expenses for inspecting the ship; (c) a fee for verification of a certificate of survey issued by the Commonwealth, another State or a classification society—$50.15; (d) a fee for issuing a certificate of survey—$8.90. ‘12 Licence to operate commercial ship or fishing ship ‘(1) Subsection (2) sets the fees for a licence, under section 97, to operate a commercial ship or fishing ship as its master or to act as a crew member of a commercial ship or fishing ship, other than a commercial ship that is a wing in ground effect craft. ‘(2) The fees are as follows— (a) for a master class 3 or skipper grade 1—$216.25; (b) for a master class 4, mate class 4 or skipper grade 2—$216.25; (c) for a master class 5 or skipper grade 3—$153.45; (d) for a coxswain—$69.75; Page 26 2009 SL No. 64

Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 9 Amendment of Transport Operations (Marine Safety) Regulation 2004 [s 18] (h) for an application, under section 156, for renewal of a commercial ship licence or fishing ship licence—$39.80; (i) for an application, under section 156, for renewal of a pilot licence or pilotage exemption certificate—$96.25. ‘17 Training approval ‘(1) This section sets the fee payable for an application for approval, under section 104, of an entity to provide training programs in the operation of ships. ‘(2) The fee is the total of the following— (a) $397.30; (b) the additional application fee payable under subsection (3). ‘(3) The additional application fee is— (a) if the applicant is an individual—$33.05; or (b) if the applicant is an unincorporated body—$33.05 for each nominee of the body when the application is made; or (c) if the applicant is a corporation—$33.05 for each nominee, or executive officer, of the corporation when the application is made. ‘(4) However, an additional application fee is payable only if the individual, nominee or executive officer is a person about whom the chief executive or the general manager proposes to ask the commissioner of the police service for a written report about the person’s criminal history for the application. ‘18 Load line certificate ‘The fee for an application for a load line certificate for a ship is $125.60. 2009 SL No. 64 Page 29

Transport Legislation (Fees) Amendment Regulation (No. 1) 2009 Part 16 Amendment of Transport Operations (Road Use Management—VehicleRegistration) Regulation 1999 [s 34] 34 Amendment of sch 2 (Category 2 vehicle registration fees) Schedule 2, part 2— omit, insert— ‘Part 2 Category 2 vehicle concessional registration fees for 1 year 1 The percentage of the registration fee payable under a concessional registration for a category 2 vehicle mentioned in schedule 3A (other than a special interest vehicle, motorised caravan or a vehicle that may be conditionally registered) is as follows— (a) for a truck with 2 or 3 axles—50%; (b) for a truck with 4 or more axles—25%; (c) for a short combination prime mover, or a short, medium or long combination truck, with 2 axles—50%; (d) for a multi-combination prime mover with 2 axles—25%; (e) for a short or multi-combination prime mover, or a short, medium or long combination truck, with 3 or more axles—25%; (f) for a trailer with 1 axle—50%; (g) for a trailer with 2 axles—35%; (h) for a trailer with 3 or more axles—30%; (i) for a special purpose vehicle—25%; (j) for a caravan, mobile library, mobile workshop, mobile laboratory or mobile billboard—35%; (k) for a bus—50%. 2 The concessional registration fee for a special interest vehicle is $74.00.
