Part 2 Amendment of Tow Truck Regulation 1999 3 Regulation amended in pt 2 This part amends the Tow Truck Regulation 1999. 4 Omission of pt 2, div 6 (Cancellation, suspension or surrender of approval) Part 2, division 6— omit. (2) Schedule 3A— insert— ‘2 Accredited person who is an approved person ‘An accredited person who is an approved person— (a) must not contravene the Act; and (b) must not contravene the Codes of Practice mentioned in the TransportOperations(RoadUseManagement—VehicleStandardsandSafety)Regulation 1999 , section 30(2). 2 ’. 2 Section 30 (Approval of modified vehicle)
s 15 8 s 17 Transport Legislation and Another Regulation No. 302, 2004 Amendment Regulation (No. 1) 2004 Part 6 Amendment of Transport Operations (Road Use Management—Vehicle Standards And Safety) Regulation 1999 15 Regulation amended in pt 6 This part amends the TransportOperations(RoadUseManagement—VehicleStandardsandSafety)Regulation 1999. 16 Amendment of s 5 (Vehicles must comply with vehicle standards) Section 5(1)— insert— ‘(g) the stationary noise level of the vehicle does not comply with the vehicle standards.’. 17 Amendment of s 23 (Currency of certificates) (1) Section 23(2)— insert— ‘(ab) for a bus not included in paragraph (a), other than a bus built to carry up to 12 seated adults (including the driver) or a bus used for private use or driver tuition—for 6 months after its issue; and (ac) for a vehicle not included in paragraph (a) or (b), that is used by a school to carry students attending the school—for 6 months after its issue; and’. (2) Section 23(2)(ab) to (c)— renumber as section 23(2)(b) to (e).
s 18 9 s 18 Transport Legislation and Another Regulation No. 302, 2004 Amendment Regulation (No. 1) 2004 18 Replacement of sch 1, pt 9, div 3 (Noise emissions) Schedule 1, part 9, division 3— omit, insert— ‘Division 3 Noise emissions ‘Subdivision 1 General ‘136 Measurement of stationary noise levels ‘(1) For this regulation, the stationary noise level of a motor vehicle must be measured— (a) in accordance with the procedure set out for the kind of vehicle in the document entitled National Stationary Exhaust Noise Test Procedures for In-Service Motor Vehicles (the national document ) published by the commission in April 2000; and (b) by using 1 of the following instruments— (i) an instrument mentioned in the national document; (ii) a type 2 meter under Australian Standard AS 1259.1—1990 Acoustics—Sound level meters—Non-Integrating ; (iii) a class 1 or 2 meter under Australian Standard AS IEC 61672.1—2004 Electroacoustics—Sound level meters—Specifications . ‘(2) In this section— commission means the National Road Transport Commission established by the National Road Transport Commission Act 1991 (Cwlth). ‘136A Meaning of certified to ADR 83/00 ‘For this regulation, a vehicle is certified to ADR 83/00 if approval has been given, under the Motor Vehicle Standards Act 1989 (Cwlth), section 10A, to place identification plates showing compliance with ADR 83/00 on vehicles of that type.
s 18 10 s 18 Transport Legislation and Another Regulation No. 302, 2004 Amendment Regulation (No. 1) 2004 ‘136B Silencing device for exhaust systems ‘A motor vehicle propelled by an internal combustion engine must be fitted with a silencing device through which all the exhaust from the engine passes. ‘Subdivision 2 Noise levels applying to vehicles not certified to ADR 83/00 ‘136C Application of sdiv 2 ‘This subdivision applies to a motor vehicle other than a vehicle certified to ADR 83/00. ‘136D Stationary noise levels—cars, car derivatives, motorbikes and motortrikes ‘The stationary noise level of a car, car derivative, motorbike or motortrike must not be more than— (a) for a car or car derivative built after 1982—90dB(A); or (b) for another car or car derivative—96dB(A); or (c) for a motorbike or motortrike built after February 1985—94 dB(A); or (d) for another motorbike or motortrike—100 dB(A). ‘136E Stationary noise levels—other vehicles with spark ignition engines ‘(1) This section applies to a motor vehicle, other than a motor vehicle to which section 136D applies, with a spark ignition engine.
