s1 3 s5 Transport Legislation Amendment Regulation (No. 5) No. 285, 2002 2002 PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Transport Legislation Amendment Regulation (No. 5) 2002 . 2 Commencement Part 7 commences on 1 February 2003. s6 4 s9 Transport Legislation Amendment Regulation (No. 5) No. 285, 2002 2002 6 Amendment of s 8 (Chief executive may require satisfactory evidence) Section 8(1)(a)(iii), ‘driver's’— omit, insert— ‘driver’. 7 Replacement of s 50 (Towing authority to be completed) Section 50— omit, insert— ‘50 Towing authority to be completed ‘ (1) This section applies if the driver of a tow truck, acting under the authority of a driver’s certificate or a miscellaneous permit, intends to tow a motor vehicle from the scene of an incident or seizure. ‘ (2) The driver must— (a) properly and fully complete a towing authority for the vehicle for signature by an authorising person for the vehicle; and (b) after the authorising person signs the towing authority, give the signed copy of the towing authority to the authorising person. Maximum penalty—20 penalty units.’. 8 Amendment of s 50A (First vehicle to be towed) Section 50A(3)— omit. 9 Amendment of s 54 (Towing charges) (1) Section 54(1), ‘Subject to subsection (1A), the’— omit, insert— ‘The’. (Road Use 14 Amendment of s 5 (Motorbike licences) (1) Section 5(3A)— omit, insert— ‘ (3A) The holder of a class RE learner, provisional, probationary or open licence is authorised to learn to ride a class R motorbike if, while riding the motorbike, the person carries a certificate in the approved form stating the person has a special need for the licence.’. (2) Section 5(6), definition “O type licence” — omit. 15 Amendment of s 6 (Other types of licences) Section 6(10)— omit. 16 Amendment of s 9 (Testing) (1) Section 9(6)(c)— renumber as section 9(6)(d) . s 17 7 s 18 Transport Legislation Amendment Regulation (No. 5) No. 285, 2002 2002 insert— ‘(c) for a class LR, MR or HR licence—the person is a police officer and the officer gives the chief executive a notice signed by the commissioner stating the officer has the ability to drive the class of vehicle that is authorised to be driven under the licence.’. 17 Amendment of s 10 (Provisional or probationary licences—class RE or C) Section 10— insert— ‘ (4) In this section— “learner licence” includes a driver licence granted outside Queensland that corresponds to a learner licence. “P type licence” includes a driver licence granted outside Queensland that corresponds to a P type licence.’. 18 Amendment of s 11 (Open licences—class RE or C) (1) Section 11(2)— insert— ‘(e) the person— (i) has, within 5 years before applying for the licence, held a class C P type licence that has been cancelled; and (ii) holds a class C P type licence; and (iii) has held the P type licence for the greater period of— (A) at least 1 year; or (B) the balance of the required period that had not expired before the P type licence was cancelled.’. (2) Section 11(3), definition “O type licence” — omit. (3) Section 11(3)— insert—

(2) Section 14A— insert— ‘ (5) In this section— “P type licence” includes a driver licence granted outside Queensland that corresponds to a P type licence.’. 21 Amendment of s 14E (Licences authorising learning to ride under Q-Ride training) Section 14E(4), definition “O type licence” — omit. 22 Amendment of s 14G (Class RE open licences) Section 14G(c)— omit, insert— ‘(c) an O type licence of another class.’.
