s1 3 s4 Transport Legislation Amendment Regulation (No. 4) No. 301, 2004 2004 Part 1 Preliminary 1 Short title This regulation may be cited as the Transport Legislation Amendment Regulation (No. 4) 2004 . 2 Commencement The following provisions commence on 5 July 2005— • part 2 • part 4 • part 5. 1 Part 2 Amendment of State Penalties Enforcement Regulation 2000 3 Regulation amended in pt 2 This part amends the State Penalties Enforcement Regulation2000. 4 Amendment of sch 3 (Transport legislation) (1) Schedule 3, entry for the TransportOperations(RoadUseManagement—RoadRules)Regulation1999 , entries for sections 222(1), 222(3) and 222(4)— omit. Part 3 Amendment of Transport Operations (Passenger Transport) Regulation 1994 5 Regulation amended in pt 3 This part amends the TransportOperations(PassengerTransport) Regulation 1994. 6 Amendment of s 15 (Public passenger services to which the Act, s 12 does not apply) Section 15(2)(a), ‘driver’s licence under the TrafficAct1949 ’— omit, insert — ‘driver licence under the TransportOperations(RoadUseManagement—Driver Licensing) Regulation 1999 ’. 7 Amendment of s 15B (Requirement for driver authorisation—public passenger services to which the Act, s 24 does not apply) Section 15B(2)(b)(i), ‘driver’s licence under the TrafficAct1949 ’— omit, insert — ‘driver licence under the TransportOperations(RoadUseManagement—Driver Licensing) Regulation 1999 ’.
s8 5 s9 Transport Legislation Amendment Regulation (No. 4) No. 301, 2004 2004 8 Amendment of s 62B (Chief executive may issue guidelines) (1) Section 62B(1)(a), as an example— insert— ‘ Example — A guideline that mentions the type of bus suitable to provide a particular school service that uses a bus to provide the service.’. (2) Section 62B(2)— omit, insert— ‘(2) A notice of the making of guidelines and of a place or places where copies of the guidelines are available must be published in the gazette. ‘(3) On the day the notice is published, copies of the guidelines must be available for purchase or free of charge at the place, or each of the places, stated in the notice. ‘(4) In this section— equipment , of a vehicle, includes a sign fitted to the vehicle. type , of vehicle, includes the type of model, design, components, construction, equipment, capability and other characteristics of the vehicle.’. Part 4 Amendment of Transport Operations (Road Use Management—Road Rules) Regulation 1999 9 Regulation amended in pt 4 This part amends the TransportOperations(RoadUseManagement—Road Rules) Regulation 1999.

s 15 7 s 15 Transport Legislation Amendment Regulation (No. 4) No. 301, 2004 2004 ‘222 School bus not to be driven without warning lights and warning signs ‘(1) This section applies if a guideline makes provision about fitting a school bus as defined in the guideline (a school bus ) with the warning lights and warning signs specified for the school bus in the guideline. ‘(2) A person must not drive a school bus to provide the public passenger service the guideline is for unless it is fitted with the warning signs and warning lights. Maximum penalty—20 penalty units. ‘(3) In this section— guideline , means a guideline under the Transport Operations(PassengerTransport)Regulation1994 , section 62B(1)(a) 2 that mentions the type of bus suitable to provide a particular public passenger service involving the transport of school children. public passenger service see the TransportOperations(Passenger Transport) Act 1994 , schedule 3. 3 ‘222A Use of warning lights—picking up or setting down school children ‘(1) This section applies to the driver of a vehicle, whether or not a school bus, fitted with the warning lights and warning signs specified for the vehicle in a guideline. ‘(2) The driver must— (a) if the driver intends to stop to pick up or set down children—signal that intention by simultaneously activating, at least 5 seconds before the bus stops, all warning lights mentioned in subsection (1) fitted to the vehicle; and (b) keep the warning lights activated until at least 5 seconds after the vehicle has started to move off after stopping. 2 Transport Operations (Passenger Transport) Regulation 1994 , section 62B (Chief executive may issue guidelines) 3 Transport Operations (Passenger Transport) Act 1994 , schedule 3 (Dictionary)
s 16 8 s 17 Transport Legislation Amendment Regulation (No. 4) No. 301, 2004 2004 Maximum penalty—20 penalty units. ‘(3) The driver must ensure the warning lights are not activated, other than as required under subsection (2), while the vehicle is on a road, unless the driver has a reasonable excuse. Example — The driver is testing the lights to ensure their satisfactory operation. Maximum penalty—20 penalty units. ‘(4) This section applies despite any requirement, under a guideline, that the vehicle be fitted with automatically operating warning lights.’. 16 Amendment of s 312 (Exemption for tow truck drivers) Section 312(2), third dot point, after ‘give way line’— insert — ‘applying to the driver’. 17 Amendment of sch 6 (Dictionary) (1) Schedule 6, definition hazard warning lights — omit. (2) Schedule 6— insert— ‘ guideline see section 222(3). hazard warning lights means a pair of yellow direction indicator lights fitted to a vehicle under the Standards and Safety Regulation that display regular flashes of light at the same time, and at the same rate, as each other. school bus see section 222(1).
