Transport Legislation Amendment Regulation (No. 3) 2011 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the Transport Legislation Amendment Regulation (No. 3) 2011 . Part 2 Amendment of Transport Operations (Road Use Management—Vehicle Registration) Regulation 2010 2 Regulation amended This part amends the Transport Operations (Road Use Management—Vehicle Registration) Regulation 2010 . 3 Amendment of s 112 (Definitions for div 5) (1) Section 112— insert — ‘ compensation order , for a victim of crime, means an order requiring the payment of compensation made under the following— (a) section 24 of the repealed CriminalOffenceVictimsAct; (b) section 663B of the repealed Criminal Code chapter. Note — See also the Victims of Crime Assistance Act 2009 , chapter 6. repealed Criminal Code chapter means the Criminal Code, chapter 65A, as it continued to apply from time to time under section 46(2) of the repealed Criminal Offence Victims Act. Transport Legislation Amendment Regulation (No. 3) 2011 Part 3 Amendment of Transport Operations (Road Use Management—Vehicle Standards and Safety) Regulation 2010 [s 4] repealed CriminalOffenceVictimsAct means the repealed Criminal Offence Victims Act 1995 , as in force from time to time before its repeal. victim of crime means a person in whose favour a court has made a compensation order.’. (2) Section 112, definition eligible person — insert — ‘(g) a victim of crime seeking information from the register in relation to obtaining payment under the person’s compensation order.’. Part 3 Amendment of Transport Operations (Road Use Management—Vehicle Standards and Safety) Regulation 2010 4 Regulation amended This part amends the Transport Operations (Road Use Management — Vehicle Standards and Safety) Regulation 2010. 5 Amendment of s 19 (Inspections by approved examiners for inspection certificate) Section 19— insert — ‘(1A) However, if an approved examiner has been given a notice under section 19A in relation to a type of registered vehicle, the approved examiner may sign a certificate of inspection for the type of registered vehicle stated in the notice.’. 2011 SL No. 204 Page 3
Transport Legislation Amendment Regulation (No. 3) 2011 Part 3 Amendment of Transport Operations (Road Use Management—Vehicle Standards and Safety) Regulation 2010 [s 6] 6 Insertion of new s 19A Part 4— insert — ‘19A Inspections by approved examiners in special circumstances ‘(1) If the chief executive is satisfied that special circumstances exist, the chief executive may, by written notice given to an approved examiner, authorise the approved examiner to sign a certificate of inspection for— (a) a registered trailer with an ATM of more than 10t; or (b) another registered vehicle with a GVM of more than 16t. Example of special circumstances — • natural disasters, including floods, affecting access to inspections of vehicles in the area in which an owner’s vehicle or inspection facilities are located or affecting the availability of inspections of vehicles because of diversion of resources for inspections or loss of inspection capability • circumstances in which authorised officers, other than police officers, are not reasonably able to provide inspection of vehicles in remote areas ‘(2) The notice must state that the authorisation is for a period, stated in the notice, the chief executive considers appropriate having regard to the special circumstances.’. 7 Amendment of sch 4 (Dictionary) Schedule 4, definition approved examiner — omit, insert — ‘ approved examiner has the meaning given by the Transport Operations (Road Use Management—Accreditation and Other Provisions) Regulation 2005 .’.
