s1 3 s4 Transport Legislation Amendment Regulation (No. 3) No. 306, 2007 2007 Part 1 Preliminary 1 Short title This regulation may be cited as the Transport Legislation Amendment Regulation (No. 3) 2007 . 2 Commencement This regulation commences on 4 February 2008. Part 2 Amendment of Tow Truck Regulation 1999 3 Regulation amended in pt 2 This part amends the Tow Truck Regulation 1999 . 4 ‘64A Insertion of new ss 64A and 64B Part 5, after section 64— insert— Waiver of additional application fee ‘The chief executive may waive the payment of an additional application fee payable under schedule 2 for a person. ‘64B Refund of additional application fee ‘(1) This section applies if— (a) an application for a licence is made and the chief executive does not notify the commissioner under section 6(2) of the Act in relation to the application; or (b) an application for a driver’s certificate or an assistant’s certificate is made and the chief executive does not

s7 6 s7 Transport Legislation Amendment Regulation (No. 3) No. 306, 2007 2007 7 Insertion of new ss 125A and 125B Part 8, after section 125— insert— ‘125A Waiver of particular fees ‘The chief executive may waive the payment of the following for a person— (a) a fee payable under schedule 8, item 1(e) or 4; (b) an additional application fee payable under schedule 8. ‘125B Refund of particular fees ‘(1) This section applies if— (a) a person makes an application for— (i) appointment as an accredited person; or (ii) accreditation as a driver trainer; or (iii) registration as a registered service provider; and (b) the chief executive does not ask the commissioner, under section 17C of the Act, for a written report about the person’s criminal history for the application. ‘(2) If the application is for— (a) appointment as an accredited person who is a pilot vehicle driver, escort vehicle driver, approved examiner or traffic controller; or (b) accreditation as a driver trainer; the additional application fee paid under schedule 8 for the application must be refunded to the applicant. ‘(3) If the application is for appointment as an accredited person who is an approved person or for registration as a registered service provider, the application fee paid under schedule 8 must be refunded to the applicant.’.

s 9 9 s 10 Transport Legislation Amendment Regulation (No. 3) No. 306, 2007 2007 Part 4 Amendment of Transport Operations (Road Use Management—Dangerous Goods) Regulation 1998 9 Regulation amended in pt 4 This part amends the TransportOperations(RoadUseManagement—Dangerous Goods) Regulation 1998. 10 Insertion of new ss 234A and 234B Part 21, after section 234— insert— ‘234A Waiver of additional application fee ‘The chief executive may waive the payment of an additional application fee payable under schedule 2 for a person. ‘234B Refund of additional application fee ‘(1) This section applies if— (a) a person makes an application for— (i) a bulk driver licence; or (ii) the renewal of a bulk driver licence; and (b) the chief executive does not ask the commissioner, under section 17C of the Act, for a written report about the person’s criminal history for the application or renewal. ‘(2) The additional application fee paid under schedule 2 for the application must be refunded to the applicant.’.
