s 20 11 s 20 Transport Legislation Amendment Regulation (No. 2) No. 186, 2005 2005 ‘153A Detaching a trailer from a prime mover or a combination road vehicle ‘(1) The driver of a prime mover, or a combination road vehicle, attached to a trailer containing dangerous goods must not detach the trailer from the prime mover or combination road vehicle unless the ADG Code, chapter 13 is complied with in relation to detaching the trailer. Maximum penalty—40 penalty units. ‘(2) A prime contractor must not authorise or instruct a driver to detach a trailer containing dangerous goods from a prime mover or a combination road vehicle unless the ADG Code, chapter 13 is complied with in relation to detaching the trailer. Maximum penalty—40 penalty units. ‘153B Unloading the vehicle ‘(1) The driver of a vehicle transporting dangerous goods by road must not unload the dangerous goods from the vehicle unless the procedure in the ADG Code, chapter 13 is complied with in relation to the goods. Maximum penalty—20 penalty units. ‘(2) A prime contractor must not authorise or instruct a driver to unload dangerous goods, from a vehicle transporting dangerous goods by road, using a procedure that does not comply with the ADG Code, chapter 13. Maximum penalty—20 penalty units.’. 20 Amendment of s 154 (Driver’s duties) Section 154(2)(a)(i), Fire and Rescue Authority Act 1990 ; and’— omit, insert— Fire and Rescue Service Act 1990 ;’.

(2) Section 231— insert— ‘(3) Subsection (4) applies if a person responsible for managing or controlling the task claims that— (a) a person employed, engaged or permitted to do the task; or (b) a person who supervised a person employed, engaged or permitted to do the task; has received instruction, and has satisfactorily completed training, specific to the task. ‘(4) The chief executive may give the person responsible for managing or controlling the task a written notice requiring the person, within 14 days after receiving the notice, to give the chief executive written evidence of the instruction and the satisfactory completion of the training. ‘(5) The person responsible for managing or controlling the task must comply with the notice, unless the person has a reasonable excuse. Maximum penalty for subsection (5)—15 penalty units.’. 30 Amendment of sch 3 (Dictionary) (1) Schedule 3, definition driver’s licence omit, insert— driver licence means a driver licence, other than a learner licence, issued under the Act.’. (2) Section 20— insert— ‘(3A) Subsection (1) also does not apply to a vehicle on a motor dealer’s approved business premises if the vehicle—
s 43 21 s 44 Transport Legislation Amendment Regulation (No. 2) No. 186, 2005 2005 (a) is clearly marked with the words ‘not for sale’ in letters at least 100mm high on a sign that— (i) is at least 210mm by 290mm; and (ii) is clearly visible from outside the vehicle; and (b) is not, by way of a sign or other marking on or near the vehicle, indicated as being for sale; and (c) is— (i) located at least 10m from other vehicles that are for sale; or (ii) separated from other vehicles that are for sale in a way that clearly shows the vehicle is not associated with vehicles that are for sale. Example for subparagraph (ii) a rope or other temporary barrier is erected around the vehicle’. 43 Amendment of s 30 (Approval of modified vehicle) (1) Section 30(2), from ‘may’ to ‘if—’— omit, insert— ‘must not approve a modification of the vehicle unless—’. (2) Section 30(3)— insert— ‘Maximum penalty—40 penalty units.’. (3) Section 30— insert— ‘(3A) A person who is not an authorised officer or approved person must not approve a modification to a vehicle.
