s1 2 s4 Transport Legislation Amendment (No. 1) No. 29, 1996 PART 1—PRELIMINARY ˙ Short title 1. This regulation may be cited as the Transport Legislation Amendment Regulation (No. 1) 1996 . PART 2—AMENDMENT OF TRAFFIC REGULATION 1962 ˙ Regulation amended in pt 2 2. This part amends the Traffic Regulation 1962 . ˙ Amendment of s 4 (Definitions) 3. Section 4— insert— “traffic controller” means a person who holds an appointment as an accredited person with the functions of a traffic controller under the Transport Operations (Road Use Management) Act 1995 .’. ˙ Amendment of s 21 (Compliance with police signals, orders or directions) 4.(1) Section 21, heading, ‘ police ’— omit. (2) Section 21(1)— insert— ‘(c) comply with a prescribed signal by a traffic controller necessary for the effective regulation of traffic.’.
s5 3 s6 Transport Legislation Amendment (No. 1) No. 29, 1996 (3) Section 21(2), after ‘police officer’— insert— ‘or traffic controller’. (4) Section 21— insert— (3) A person does not commit an offence against a provision of this regulation if compliance with the provision is inconsistent with— (a) a signal, order or direction by a police officer; or (b) a signal by a traffic controller.’. PART 3—AMENDMENT OF TRANSPORT OPERATIONS (ROAD USE MANAGEMENT) REGULATION 1995 ˙ Regulation amended in pt 3 5 . This part amends the Transport Operations (Road Use Management)Regulation 1995 . ˙ Insertion of new s 4D 6. Part 1, after section 4C— insert— ˙ Function of traffic controllers 4D. The function of an accredited person who is a traffic controller is to direct traffic when there is a danger or obstruction to traffic. Examples of danger or obstruction 1. Roadworks. 2. Sporting events on roads. ’.
s7 4 s7 Transport Legislation Amendment (No. 1) No. 29, 1996 ˙ Insertion of new s 4E 7. Part 2, before section 5— insert— ˙ Vehicles part applies to 4E.
