1   Short title

This regulation may be cited as the Transport Legislation Amendment Regulation 2024.

Part 2    Amendment of Rail Safety National Law (Queensland) Regulation 2017

2   Regulation amended

This part amends the Rail Safety National Law (Queensland) Regulation 2017.

3   Amendment of s 8 (Requirements for providing specimen of breath or saliva for analysis—Act, s 34)

(1)Section 8, heading, ‘providing’—
omit, insert—

how to provide

(2)Section 8(3), definition collection unit—
insert—

(ca)a saliva collection swab from a Quantisal; or

(3)Section 8(3), definition collection unit, paragraphs (ca) and (d)—
renumber as section 8(3), definition collection unit, paragraphs (d) and (e).

Part 3    Amendment of Traffic Regulation 1962

4   Regulation amended

This part amends the Traffic Regulation 1962.

5   Amendment of s 210F (Calibration testing of particular photographic detection devices)

(1)Section 210F(2)—
omit, insert—

(2)The chief executive or commissioner may, if satisfied that an entity is competent to conduct calibration testing of a relevant device, approve the entity to conduct calibration testing for this section.

(2A)An entity approved under subsection (2) (an approved testing entity) must conduct calibration testing of a relevant device.

(2)Section 210F(4), definition approved testing entity—
omit.

(3)Section 210F(2A) to (4)—
renumber as section 210F(3) to (5).

Part 4    Amendment of Transport Operations (Road Use Management—Vehicle Registration) Regulation 2021

6   Regulation amended

This part amends the Transport Operations (Road Use Management—Vehicle Registration) Regulation 2021.

7   Amendment of s 28 (Term)

(1)Section 28(2)—
insert—

(ba) both of the following apply—

(i)the registered operator of the vehicle is a dealer;

(ii)the vehicle’s purpose of use is recorded in the register or nominated in a registration application as dealer purposes; or

(2)Section 28(2)(ba) and (c)—
renumber as section 28(2)(c) and (d).

(3)Section 28(5), ‘subsections 2(c)’—
omit, insert—

subsections (2)(d)
